GPS COORDINATES: N: 36.19767° E: -75.88223° FACILITY CONTACT INFORMATION: Name: J Bryan Smith Address: PO Box 2560 Kitty Hawk NC 27949 Telephone: (252) 255-2030 Email address: info@atlanticsewagecontrol.com PARTICIPANTS: Jeffrey Bullard (DWM) STATUS OF PERMIT: Active EXPIRES: 04/01/2019 PURPOSE OF SITE VISIT: Routine STATUS OF PAST NOTED VIOLATIONS: NA OBSERVED VIOLATIONS: A. 15A NCAC 13B .0842(a)(12) all septage discharges, including aerial drift from discharges, shall be made within the permitted boundaries of the land application site; B. 15A NCAC 13B .0842(a)(16) the site shall be managed to minimize soil erosion and surface water runoff. Appropriate soil and water management practices shall be implemented and maintained in accordance with the erosion and run-off management plan submitted in accordance with Rule .0840(c)(14) of this Section. All water control structures shall be designed, installed, and maintained to control the run-off resulting from a 10-year storm; The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 2 of 2 ADDITIONAL COMMENTS 1) An appropriate Septage Land Application Sign was present at the entrance to the site. 2) Roads were passable. 3) Some field markers were run over or missing. Any field markers knocked down or out of place need to be restored. 4) (See item A in the Observed Violations section) an NOV was issued for discharging septage outside of the permitted field boundaries on southwestern boundaries of fields 1 and 3. 5) Applications appeared to be following the permit and nutrient management plan within the permitted boundaries. (see line 11 below for buffer violations) 6) Crops were transitioning to cool season variety, no winter overseeding was observed, hay was bailed and awaiting removal. 7) pH not checked. No application at time of inspection. 8) No objectionable odors noticed. 9) Setbacks not checked. 10) Records were received from soil consultant for review. 11) (See item B in Observed Violation section) NOV issued for buffer violations at the southwestern edge of Field 1 and 3.
