Permit Expired on September 30, 2020. You were provided with your permitting engineer, Benjamin Jackson's, contact information, if assistance with the renewal process is required. PURPOSE OF SITE VISIT: Comprehensive Inspection STATUS OF PAST NOTED VIOLATIONS: A. 15A NCAC 13B .0566 (2) states, "The facility shall only accept those solid wastes which it is permitted to receive." And the Facility Permit 42A-LCID, issued September 30, 2015, Attachment 3, Part I, Number 4 states, "This facility is permitted to receive land clearing waste; yard trash; untreated and unpainted wood; uncontaminated soil; inert debris such as unpainted rock, brick, concrete, and concrete block; and asphalt in accordance with NCGS 130- 294 (m)." RESOLVED: During this inspection, no unacceptable wastes were identified within the waste stream. B. 15A NCAC 13B .0566 (4) states, "Adequate soil cover shall be applied monthly, or when the active area reaches one acre in size, whichever comes first." Page 1 of 4 FACILITY COMPLIANCE INSPECTION REPORT D_E Q�� Division of Waste Management NORTH CAROLINA o"—t0E-!�'m"""°"""' Solid Waste Section PARTIALLY RESOLVED: At the time of this inspection, the western portion of the site has been covered with soil. The active working face, the western edge of the LCID, was smaller than one acre and mostly covered with soil. An area of asphalt waste was identified near the working face. The asphalt waste must also be covered with soil monthly or when the active area reaches one acre in size. Uncovered vegetative waste was observed in the eastern unactive portion of the LCID. Per 15A NCAC 13B .0566 (7), "Provisions for a ground cover sufficient to restrain erosion must be accomplished within 30 working days or 120 calendar days upon completion of any phase of landfill development." The waste identified on the inactive portion of the LCID needs to be covered within 30 days of receipt of this report. C. 15A NCAC 13B .0566 (10) states, "Surface water shall be diverted from the working face and shall not be impounded over waste." And 15A NCAC 13B .0566 (11) states, "Solid waste shall not be disposed of in water." UNRESOLVED: During the inspection, surface water was observed ponding against the southern edge of the LCID. Mr. Rightmyer stated that the old roadway had been cut to allow for drainage of the standing water. The area needs to be properly graded to promote drainage away from the LCID. D. Facility Permit 42A-LCID, issued September 30, 2015, Attachment 3, Part 1, Number 8 states, "Excavation, grading and fill material side slopes must not exceed a ratio of three horizontal feet to one vertical feet (3:1)." Some of the slopes, especially the slope leading to the front entrance, where the water was ponding, were steeper than 3: 1. This issue was also noted in the January 29, 2019, September 5, 2018 and February 13, 2018 inspection reports. OBSERVED VIOLATIONS: None The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. ADDITIONAL COMMENTS 1) Roanoke Valley LCID Landfill is owned and operated by Rightmyer Machine Rentals, Inc. 2) This facility is permitted to receive land clearing waste; yard trash; untreated and unpainted wood; uncontaminated soil; inert debris such as unpainted rock, brick, concrete, and concrete block; and asphalt in accordance with NCGS 130- 294(m). 3) The facility has set a maximum disposal rate of 70,000 cubic yards per year (average of 275 cubic yards per day based on 253 operating days per year). 4) This facility is permitted to receive waste generated Halifax, Bertie, Hertford, Northampton, Warren, Vance, Granville, Franklin, Nash, Wilson, Edgecombe, Pitt, Martin, Chowan, and Gates Counties in North Carolina and Suffolk, Southampton, Greensville, Brunswick, Mecklenburg, Lunenburg, Nottoway, Amelia, Chesterfield, Dinwiddie, Prince George, Sussex, Surry, and Ile of Wright Counties in Virginia. 5) The facility is not open to the public. 6) Photographs were taken during the inspection.
