OBSERVED VIOLATIONS:
Peat media removed from advanced treatment units was observed stockpiled on the ground near the storage tanks in violation of: 15A NCAC 13B .0832 GENERAL PROVISIONS The permit requirement of G.S. 130A-291.1(c) applies to persons who remove septage, and other waste materials or spent media from wastewater systems permitted by the Department of Health and Human Services, under the authority of Article 11, Chapter 130A of the North Carolina General Statutes; 15A NCAC 13B .0838 STANDARDS FOR SEPTAGE DETENTION AND TREATMENT FACILITIES (e) Each detention and treatment facility shall be designed, constructed, and maintained to: (1) prevent leaks or the flow of septage out of the facility into the seasonally high water table, onto the ground surface, or into any surface waters;
The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.

ADDITIONAL COMMENTS
1. An appropriate No Trespassing sign was displayed.
2. The tanks were accessible for inspection.
3. The tanks appeared structurally sound.
4. Septage transferals appear to have been made in a safe and sanitary manner.
5. No vectors or objectional odors were noticed.
6. Approved setbacks appear to be met
7. The access road was passable.
8. Spent peat media was stockpiled on the ground southeast of the tanks. (see Observed Violations
page 1)
