The Notification is described by the deed recorded in BOOK: 550 PAGE: 093. PURPOSE OF SITE VISIT: Compliance Inspection STATUS OF PAST NOTED VIOLATIONS N/A OBSERVED VIOLATIONS 15A NCAC 13B .0566 (12), "Open burning of solid waste is prohibited." Since the February 2016 inspection, the area to the north of the permitted LCID has been cleared. A waste pile containing unacceptable wastes such as plastic toys, carpet, telephone poles, and painted wood was identified within this cleared area, to the northwest of the permitted LCID. Evidence of the burning of the waste was observed and the center of the waste was smoldering during the September 24, 2020 inspection. Page 1 of 4 FACILITY COMPLIANCE INSPECTION REPORT D_E Q�� Division of Waste Management NORTH CAROLINA o"' t0E­!�'m"""°"""' Solid Waste Section 15A NCAC 13B .0505 (11) (c), "Spoiled foods, animal carcasses, abattoir waste, hatchery waste and other animal waste delivered to the disposal site shall be covered immediately." An animal disposal area was observed either on top of the NLCID to the left of the driveway or directly to the west of the entrance notified LCID. The animal carcass disposal area was identified to be littered with bones and lime residue. The lime residue runoff/wastewater had flowed from the animal carcass disposal area, crossed the road and into a small drainage ditch. Several trees along the drainage ditch were identified to be dead at the time of the inspection. See "Corrective Actions" below for the required measures necessary to resolve these violations. The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. ADDITIONAL COMMENTS: 1. It does not appear that the site has been used for much LCID since the last inspection. The vegetation of the LCID is overgrown and should be mowed to allow proper inspection of the LCID. 2. A sign is posted on the gate at the entrance showing the contact name and number in case of emergency. 3. The access road is of all-weather construction and appears to be properly maintained. 4. Permanent, clearly visible edge of waste markers must be established at the site, showing the under two acres boundary for waste disposal. This has been commented on in previous reports. One EOW marker was observed along the western edge of the LCID, adjacent to the roadway. Additional EOW markers need to be placed to ensure that the LCID is under 2 acres. 5. As discussed in the February 2016 inspection, miscellaneous plastic items and aluminum cans were identified within what appears to be ditch cleaning dirt. These items should be removed on a frequent basis, preferably, when the truck empties a load. 6. Dead animals are not permitted for disposal at a notified LCID. It is recommended that you contact the North Carolina State Veterinarian (02 NCAC 52C .0102 Disposal of Dead Animals) on the proper guidance for the management and/or disposal of dead animals or transport them to a facility permitted to receive them for disposal. 7. Corrective measures are necessary at this facility. Measures to bring the facility into compliance must be completed within 30 days' receipt of this report. The SWS will conduct a follow-up inspection in 30 days to ensure issues noted in this inspection report have been addressed. 8. Digital photographs were taken during the inspection. CORRECTIVE ACTIONS 1. Immediately cease the burning of material at the site. The burned waste needs to be removed and properly disposed of at a permitted facility. 2. The animal carcasses need to properly be disposed of. The carcasses need to be immediately buried upon arrival at the site. The lime residue needs to be mitigated so that the trees adjacent to the animal carcass area are not damaged.
