Permit Condition 2 This site shall be operated and maintained in accordance with the approved nutrient management plan. A significant amount of weeds was noted on Fields 8 & 15 which is not the approved crop per the approved plan – various amounts of weeds & other vegetation were noted on other fields. Per the nutrient management plan weed control will be implemented as needed to maintain an adequate stand of the approved crop for each field. A weed problem was previously noted last year (on the audit of 9/13/2019). Also noted that the fescue stand on various fields appears to be suffering and needs to be reestablished. Contact your local extension agent for guidance on the appropriate weed control needed after this winter and advice on reestablishing the appropriate crop stands as needed. Field 13, 14 & 16 have been harvested and the hay bales are currently sitting on the fields. Some other fields need to be harvested asap (while in accordance with the 30 day waiting period. Some fields have been replanted/reworked. 2. The field posts appear accurate. It appears that the approved setbacks are being met, but were not measured at this time. No apparent sign of land application outside the permitted boundaries. No sign of heavy or recent application. No odors noted. 3. The required signs are posted and the access road is adequate. 4. Reviewed the land application site logs. It appears that the required information is being maintained. 5. Soil samples shall be taken by the operator at this time (gave Mr. Woodall some soil boxes). Mr. Woodall stated that he had attended the continuing education class in Morganton. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.
