Markers were present and visible. OBSERVED VIOLATIONS: 1) Septage was observed to be ponded on a portion of the site. See picture below. The ponding of septage on the site is a violation of Rule .0838(a)(7) that states “Septage shall be applied to the surface of the land from a moving vehicle in such a manner as to have no standing liquid or soil disturbance resulting from the waste flow after the discharge is complete.” 2) Following the ponded area of the field downslope to the field boundary, a hole that was outside of the permitted boundary was found to have septage in it. See picture below. Septage observed outside of the permitted boundary is a violation of Rule .0838(a)(12) that states “All septage discharges, including aerial drift from discharges, shall be made within the permitted boundaries of the land application site.” CONTINUE ON NEXT PAGE FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 2 of 4 The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. ADDITIONAL COMMENTS 1) The required signage was present along access roads. 2) Access roads ok. Has been raining a lot. Roads a little muddy. 3) All markers appeared to be up. 4) Evidence where septage had run downslope was observed. Also, septage was still ponded at the base of the slope. As noted above in the observed violations, the ponding of septage is a violation of Rule.0838(a)(7). While no ruts greater than 3 inches in depth were observed, the site was wet enough to allow for some shallower ruts and for the runoff of the septage applied recently. Need to monitor site closely for conditions that may led to runoff. Septage must not be applied in a way that will lead to ponding or runoff of septage. 5) Evidence where septage had ran off the field and into a hole. As noted above in the observed violations, the runoff of septage outside of the permitted boundary is a violation of Rule.0838(a)(12). All septage discharges shall be made within the permitted boundary of the field and not allowed to exit the permitted boundary by runoff, aerial drift, etc. Fields that are sloped have a greater opportunity for runoff. Closely monitor your application method such as speed and spread width and the site conditions such as soil wetness. 6) Ollie texted my pictures of the cleanup process on 01/08/2020. See pictures below. All septage was removed from the hole and hydrated lime was applied over the area. Septage was also pumped out of the ponded area of the field. All septage was properly disposed of. Hole to be filled in when site conditions allow for soil to be placed in the hole. 7) Fescue crop looked ok. 8) pH of septage not checked. 9) No objectionable odors noticed. 10) Setbacks appear to be as permitted. 0BRuts / groves in the field where septage flow downslope.
