PURPOSE OF SITE VISIT: Routine STATUS OF PAST NOTED VIOLATIONS:
On the previous inspection report, an observed violation was noted to Rule .0838(a)(18) for failure to
reestablish an adequate fescue stand as within the nutrient management plan.
OBSERVED VIOLATIONS:
1) Both fields continue to have a poor stand of fescue which is the approved crop within the nutrient
management plan. The poor crop coverage is a violation of Rule .0838(a)(18) that states “Approved
nutrient management plans shall be followed.” Also Permit Condition 2 states “This site shall be
operated and maintained in accordance with the nutrient management plan submitted by...” Refer to
“status of past noted violations” above. Failure to reestablish an adequate fescue cropstand will
result in site closure.
The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.

ADDITIONAL COMMENTS
1) The required signage was present at Field 1A.
2) The access road was in good shape.
3) Required markers were present.
4) No septage discharges noticed outside of the permitted boundaries.
5) Applications appeared to follow the nutrient management plan. No spot dumps or thick applications
noticed.
6) Both fields have a poor stand of fescue. The poor coverage of fescue is a violation of Rule .0838(a)(18).
See Observed Violations above. A lot of weeds present. Fields need improvement as stated in
previous inspection reports. Will schedule a site visit to review crop with you. Fields will likely be
closed.
7) No objectionable odors noticed today.
8) No recent application noticed. pH not checked.
9) Setbacks not checked.
10) Need to follow up on the soil samples.
