Yard Waste Facility Notification expires on June 1st each year PURPOSE OF SITE VISIT: Comprehensive Inspection STATUS OF PAST NOTED VIOLATIONS: None OBSERVED VIOLATIONS: None FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 2 of 3 ADDITIONAL COMMENTS On October 13, 2020, Chuck Kirchner met with Tim Chapin to conduct a comprehensive inspection of the Gorilla Materials, Inc. YWN off Mount Hermon Church Road in Durham, Orange County. 1. The yard waste notification (YWN) is located at Gorilla Materials, Inc. which specializes in concrete and asphalt recycling. 2. The site is primarily dedicated to concrete storage and crushing, land clearing debris (LCD) storage and grinding, aggregate and mulch storage. 3. The designated area used for the YWN is < 2 acres. 4. Yard Waste Notification facilities (or sites) are small composting and/or mulching operations designed to repurpose yard waste into a soil addition or beneficial landscaping material. These small-scale facilities can operate without the need for a full permit from the Division of Waste Management. While there is no permit required for operation, the DWM does require that a notification form detailing facility operations be submitted prior to beginning operations and annually thereafter. 5. Material must be processed and removed from the site on a regular basis, so that 75 percent, by weight or volume, of material is removed within a calendar year of receipt. In other words, Yard Waste Notification sites are not approved for permanent storage or final disposal. Facilities are required to track incoming/outgoing volumes and provide the information to the Division of Waste Management upon request to verify compliance. 6. Please provide this office with current quantities of processed and unprocessed materials on site. 7. Gorilla Materials, Inc. is required to track incoming and outgoing volumes of material and should be able to provide estimates of material on site and throughput numbers upon inspection. 8. The YWN site is open to the public. 9. The Solid Waste Section has received your yard waste facility notification renewal form. If your facility only processes and stores less than 6,000 cubic yards of the following materials on a quarterly basis, you can continue to operate by notifying the Section on an annual basis by June 1st of each year. If your composting activities grow to more than 6,000 cubic yards quarterly or exceed the 2-acre size limitation please contact the Solid Waste Section for assistance in obtaining a permit. 10. Facilities operating under notification shall only receive: a. Untreated and unpainted wood waste. b. “Silviculture Waste” as defined in 15A NCAC 13B .0101(41); waste materials produced from the care and cultivation of forest trees, including bark and woodchips. c. “Yard Trash” as defined in 15A NCAC 13B .0101(55); solid waste resulting from landscaping and yard maintenance such as brush, grass, tree limbs, and similar vegetative material. d. “Yard Waste” as defined in 15A NCAC 13B .0101(56); yard trash and land clearing debris to include stumps, limbs, leaves, grass, and untreated wood. The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. Facilities operating under notification are required to operate in accordance with 15 NCAC 13B .1406 and .1404(a)(1)-(10). 12. Material onsite should be kept in manageable windrows. 13. Mr. Chapin stated that the woody debris is to be ground and used as boiler fuel at a power plant. 14. Most of the processed mulch was observed to have been previously removed from site during this inspection. 15. Mr. Chapin stated that no composting of materials is conducted at this facility. No grass or leaf waste was observed on site. 16. Open burning of waste is prohibited. 17. Fires shall be reported to the Division orally within 24 hours of the incident and in writing within 15 days of the incident. 18. Ensure adequate fire lanes are maintained. 19. Access roads are of all-weather construction. 20. The facility access is secured by a locked gate. 21. The facility sign is required to include YWN-68-004 and include emergency contact information.
