The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.

ADDITIONAL COMMENTS
On October 13, 2020, Chuck Kirchner met with Dave Parrish to conduct a comprehensive inspection of the Parrish Farms YWN off Parrish Farms Road in Chapel Hill, Orange County.
1. The yard waste notification (YWN) is located on a parcel of land owned by Melvin Parrish. 2. Yard Waste Notification facilities (or sites) are small composting and/or mulching operations designed to repurpose yard waste into a soil addition or beneficial landscaping material. These small-scale facilities can operate without the need for a full permit from the Division of Waste Management.
While there is no permit required for operation, the DWM does require that a notification form detailing facility operations be submitted prior to beginning operations and annually thereafter. 3. Material must be processed and removed from the site on a regular basis, so that 75 percent, by weight or volume, of material is removed within a calendar year of receipt. In other words, Yard
Waste Notification sites are not approved for permanent storage or final disposal. Facilities are required
to track incoming/outgoing volumes and provide the information to the Division of Waste Management upon request to verify compliance. 4. The YWN site is open to the public but most LCD on site is associated with the Parrish’s grading business. Dave Parrish stated that not much LCD material had been added in the last year. 5. The Solid Waste Section has not received your yard waste facility notification renewal form. If
your facility only processes and stores less than 6,000 cubic yards of the following materials on a quarterly basis, you can continue to operate by notifying the Section on an annual basis by June 1st of each year. If your composting activities grow to more than 6,000 cubic yards quarterly or exceed the 2-acre size limitation please contact the Solid Waste Section for assistance in obtaining a permit. 6. Facilities operating under notification shall only receive:
a. Untreated and unpainted wood waste. b. “Silviculture Waste” as defined in 15A NCAC 13B .0101(41); waste materials produced from the care and cultivation of forest trees, including bark and woodchips. c. “Yard Trash” as defined in 15A NCAC 13B .0101(55); solid waste resulting from landscaping and yard maintenance such as brush, grass, tree limbs, and similar vegetative material.
d. “Yard Waste” as defined in 15A NCAC 13B .0101(56); yard trash and land clearing debris to include stumps, limbs, leaves, grass, and untreated wood. 7. Facilities operating under notification are required to operate in accordance with 15 NCAC 13B .1406 and .1404(a)(1)-(10). 8. Material onsite shall be kept in manageable windrows. No material should be landfilled on site. If you
desire to landfill material on site please contact the Solid Waste Section for assistance.
9. Mr. Parrish stated that the woody debris is to be ground and used as needed.
10. Ensure processed and unprocessed material on site is less than 6000 cubic yards quarterly.
11. Records should be maintained of the amount of LCD accepted. 12. Open burning of waste is prohibited. 13. Fires shall be reported to the Division orally within 24 hours of the incident and in writing within 15 days of the incident.
14. Ensure adequate fire lanes are maintained.
15. Access roads are of all-weather construction.

16. The facility access should be secured by a locked gate.
17. The facility sign should include YWN-68-004 and include emergency contact information.
