OBSERVED VIOLATIONS: None. The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. ADDITIONAL COMMENTS: 1. The facility was observed to be clean and well -maintained. Page 1 of 3 FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management NORTH CAROLINA Solid Waste Section 2. Access roadways are of all-weather construction and maintained in good condition. During the inspection, a water truck was observed washing down the edges of the paved portion of the roadway where recent rains had caused mud to accumulate. 3. The collection area for concrete, asphalt, and brick (CAB), located just off the access roadway on the east side of the active landfill, was inspected. The internal roadway had been improved since the previous inspection, and the tipping area was configured to allow as much maneuvering room as possible for heavy trucks and equipment. The site contained stockpiles of crushed and unprocessed material. Some brick and used asphalt had been segregated to be used for repairs to the tipping area. A sediment basin had been constructed on the eastern edge of the site, as required by the approved erosion control plan. No unacceptable materials were observed at the site. 4. Heavy rain events had been occurring over the past several months; however, the side slopes of the active landfill were found to be in relatively good condition. Some small erosion rills were noted toward the toe of the slope in some areas. Mr. Rickett stated that repairs have been ongoing, and pointed out swaths of slope that had been regraded with additional soil cover tracked in to prepare for another round of seeding. 5. The working face was small and fairly well contained, and waste appeared to be well compacted. No unacceptable materials were observed in the working face. 6. Panels of wind fence and tarp rolls were stored in an area adjacent to the tipping area. Uncovered waste and windblown litter were prevalent in this area. After consulting with staff onsite, Mr. Rickett stated that the waste had been churned up as heavy equipment was changed out for maintenance. He pointed out piles of soil that had been brought up for use in leveling the area and applying cover. Mr. Dively provided photos after the inspection showing the complete repair work with all of the waste covered. 7. The slope below the working face had been stabilized and no erosion was evident. Mr. Rickett pointed out a small basin that had been installed part way down the slope to help slow the water. He explained that this area has accumulated water naturally, so creating the basin was a logical step in addressing the run-off issues on the slope. 8. The large pond at the bottom of the slope had been cleared of sediment and appeared to be functioning properly. The area adjacent to the working face had been churned up by heavy equipment.
