PURPOSE OF SITE VISIT: Partial Inspection STATUS OF PAST NOTED VIOLATIONS: A. RESOLVED: 15A NCAC 13B .0302(3) states: "Water that comes into contact with solid waste will be contained on -site or properly treated prior to discharge from the site." Cleaning and shutting down the picking line, containing all waste within the limits of the covered tipping floor, and regular maintenance of the trench drain has eliminated leachate creation outside the leachate collection system. Contact the Solid Waste Section prior to resuming operations on either or both of the picking lines. CORRECTIVE MEASURES IN PROGRESS: 15A NCAC 13B .0201(c) states, in part: "No solid waste management facility shall be established, operated, maintained, constructed, expanded, or modified without a currently valid permit issued by the Division for the specified type of disposal activity." Waste continues to be removed from the South Site and disposed of properly. Mr. Petty estimated that between 1200 and 1300 tons had been removed to date. C. CORRECTIVE MEASURES IN PROGRESS: 15A NCAC 13B .0203(d) states: `By receiving solid waste at a permitted facility, the permittee(s) shall be considered to have accepted the conditions of the permit and shall comply with the conditions of the permit." Permit to Operate No. 3424, ATTACHMENT 1, PART I: GENERAL PERMIT, general permit condition 6 states, in part, "Operation of this solid waste management facility shall be in accordance with the Solid Waste Management Rules, 15A NCAC 13B, Article 9 of the Chapter 130A of the North Carolina General Statutes (NCGS 130A-290, et seq.), the conditions contained in this permit, and the approved plan." Permit to Operate No. 3424, ATTACHMENT 1, PART VI, TRANSFER STATION/TREATMENT & PROCESSING UNIT(S), List of Documents for Approved Plan, includes the Operations Manual, December 31, 2015 (DIN 25646). Section 2.8 of the approved Operations Manual (December 31, 2015), Processing Area Legend, indicates that the preferred location for aging trommel-overs is the South Site. No additional waste has been added to the South Site since the transfer of ownership in December 2019, and work continues in the removal and disposal of the waste on the South Site as weather permits. OBSERVED VIOLATIONS: No new violations were observed during this inspection. to resolve past observed violations. See comments above and below regarding ongoing activities The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. ADDITIONAL COMMENTS 1. The purpose of this inspection was to observe progress made in cleaning up the facility, grinding and removing the wood waste stockpiled on the northwest site, establishing a separation between stormwater and leachate, and removing and properly disposing of the waste stockpiled on the South Site . 2. The facility was actively accepting waste during the inspection. The weather was dry and breezy. 3. In general, the facility appeared to be clean and well -maintained at the time of this inspection. Windblown litter was minimal and well -managed. No waste was observed outside the limits of the covered tipping floor. 4. A wall had been installed on the eastern side of the tipping floor, and the loader operator was using the wall to push up waste and load it into an open -topped trailer parked outside the wall. The wall was constructed of large concrete blocks. Waste was being loaded into trailers during the inspection, and the accumulated waste covered approximately half of the tipping floor. Ronnie Petty stated that the waste is managed during operating hours and the tipping floor is cleared at the end of the operating day. 5. The trench drain in the tipping floor appeared to be functioning properly. No waste was observed on the drain covers, and Mr. Petty stated that the covers are cleaned at least daily and the drain itself is shoveled out, as necessary. No evidence indicating that leachate had flowed outside of the tipping floor and trench drain was observed. It should be noted that the previous facility owners had been advised to remove the solid drain Page 2 of 7 NORTH CAROLINAD_E Q�� OepeNnenf of Envlronmmbl 0w1� FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section covers and replace them with grates, as originally designed and approved. The leachate collection system will be evaluated as a part of the permit application, and changes may be required. 6. Both picking lines had been shut down, cleaned, and cleared of waste. Ronnie Petty stated that eliminating waste sorting from the operation was under consideration. The area to the east of the picking line was also found to be clean and clear of debris. 7. A portion of the main operations area, located between the tipping floor and the picking line, is currently being used as a loading area for waste. This area was also found to be clean and clear of waste. Ronnie Petty outlined his future plan to partially enclose the tipping floor, leaving the south end open for loading. He added that the current loading area would be leveled, eliminating the ramps and elevation changes that had been constructed by the previous owners of the facility. 8. Ronnie Petty stated that the trailer that had previously been used as the facility office had been cleared of Abbey Green records and was being rented to another business as a temporary office. He added that all facility records were now stored in the scale house and were available for review upon request. 9. The sediment pond, located north of the scale house, appeared to be free of waste and functional. Cat tails and woody growth had encroached on the fore bay of the pond. Ensure that the sediment pond is maintained as required by the approved erosion control plan. 10. The North Site was being used primarily for equipment storage. Ronnie Petty stated that inert debris operations would be conducted in this area, and pointed out a small stockpile of soil and inerts being stored there. Several pieces of unacceptable waste were observed in the stockpile, and Ronnie Petty stated that he would have the material moved to the tipping floor for disposal. Please ensure that waste loads directed to the North Site are screened for unacceptable waste as they are received. 11. The south slope of the beneficial fill area that makes up part of the North Site appeared to be stable, and vegetative cover had grown up on the slope. Erosion control measures located between the toe of the beneficial fill slope and the creek, observed from the top of the slope, appeared to be in need of maintenance. The baffles in the sediment trap were not visible due to the vegetation that had become established in the area; however, a portion of the silt fence that had been installed between the sediment trap and the creek was visible and appeared to be intact. Ensure that all erosion control measures are maintained as required by the approved erosion control plan. 12. No ponding water was observed on the North Site, and Ronnie Petty stated that his staff had worked to regrade the area during the spring to prevent runoff problems. 13. The access roadway between the North Site and the northwest operations area (formerly, the Leased Site) was found to be in good condition. Gravel and clean soil had been compacted to stabilize the roadway to enable the safe maneuvering of the trucks and heavy equipment used to manage and haul the processed wood waste on the site. A number of empty roll -off containers were stored in this area. Ronnie Petty confirmed that no waste is stored in this area. The area appeared to be clean and well -maintained. 14. The large stockpile of wood waste that had accumulated on the NW operations area had been ground during the spring and much of the processed wood waste/mulch had already been removed from the site. During this inspection, mulch was observed being loaded into trailers and hauled offsite by a contractor. Ronnie Petty stated that he was no longer accepting "scalpings" generated by Ingredion, and was working to have the existing scalpings stockpile removed as well. He added that approximately 75 tractor trailer loads of processed wood waste had already been removed from the facility. A small pile of clean wood pallets was observed on the Leased Site, and Ronnie Petty stated that his staff separates wood pallets from loads of waste as they are managed on the tipping floor. No unacceptable materials were found on the Leased Site, and no ponding water was observed in the wood waste operations area. Ronnie Petty stated that he was undecided as to how to regrade the Leased Site to control stormwater in the future. 15. The area south of the covered tipping floor had previously been used as an inert debris stockpile and operations area. The entire inert debris stockpile had been crushed and a stockpile estimated to contain 1500 tons remained. The crushed inerts are being used primarily to repair access roadways and operations areas at the facility. Ronnie Petty explained that the remainder of the inerts had been used to level the area, eliminating the erosion caused by the flow of surface water down the roadway and across the southern portion of the site toward the stormwater swale. No erosion was evident, and no ponding water was observed. Ronnie Petty also pointed out that all of the wood waste found on this portion of the site had been removed so that only beneficial Page 3 of 7 FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management NORTH CAROLINA Solid Waste Section fill remained. 16. What had previously been identified as a stockpile of gypsum had been found to contain significant contamination. Ronnie Petty stated that, as a result, the entire stockpile had been disposed of at the A-1 Sandrock C&D Landfill. 17. A notified LCID landfill (113 # N1044) is located on the northwest side of the what formerly had been the inert debris storage and processing area. Please ensure that current operations do not damage the integrity of the landfill cap. 18. A large amount of waste stockpiled on the South Site had been removed, and most of it had been disposed of at the A-1 Sandrock C&D Landfill (permit # 4117). Ronnie and Jimmy Petty stated that dump trucks from their other businesses were being used to haul the material away for disposal, and that weather was proving to be an obstacle to finishing the task. 19. Ronnie Petty explained that, based on Mr. Lane's evaluation of the laboratory analysis of the material sample, the option to screen the waste had been discontinued and all waste was being landfilled. 20. Most of the unacceptable material that had been previously observed in the waste piles on the South Site had been cleaned up and minimal windblown litter was visible in the area. Ronnie and Jimmy Petty pointed out the silt fencing and rock that had been installed along a portion of the access roadway near the southern end of the South Site. These improvements appeared to be effective in preventing waste and sediment from leaving this end of the site and crossing the roadway to the stormwater swale; however, additional erosion control measures may be required. 21. Please work with City of Winston-Salem Erosion Control staff to ensure that regrading work and other stormwater control measures are acceptable and meet the conditions of the approved erosion control permit. Waste resulting from the loading process is cleaned up daily.
