Hope Mills, NC 28348 PARTICIPANTS: David Powell, Environmental Senior Specialist, SWS STATUS OF PERMIT: Yard Waste Notification – 3/9/2020 Notified LCID – Closed PURPOSE OF SITE VISIT: Follow Up Inspection STATUS OF PAST NOTED VIOLATIONS: 1. 15A NCAC 13B .0201 (a) - UNRESOLVED 2. 15A NCAC 13B .0201 (b) - UNRESOLVED 3. 15A NCAC 13B .0201 (c) – UNRESOLVED 4. 15A NCAC 13B .1402 (g) (1) (D) – UNRESOLVED OBSERVED VIOLATIONS: NA The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. David Powell conducted a site visit to check the progress made towards addressing issues discussed on previous visits and Notice of Violation. 2. Behind parking area, just inside fence and to the right, seems to be in same condition as last inspection. There is still much plastic, wire, metal and other misc. items comingled in the C and D Waste onsite. 3. There is an unknown quantity of smaller pieces of unapproved waste, such as wire, insulation and foam pieces, plastic etc., comingled with the waste on top of the Closed NLCIDLF. 4. The owners were informed at the time of the last inspection and in the Notice of Violations to process the YW and remove it from top of the closed NLCIDLF. Operating on top of a closed out solid waste facility is a violation and must stop. Process and remove all waste material. 5. The excavated C and D material was still piled onsite on top of the closed out NLCIDLF. Some unapproved wasted filled a roll off container. There is an unknown quantity of smaller pieces of unapproved waste, such as wire, insulation and foam pieces, plastic etc., comingled within the waste on top of the closed NLCIDLF. All waste dumped on top of the closed NLCIDLF must be removed and transported to a permitted landfill for FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 3 of 4 disposal. DO NOT MOVE THIS MATERIAL TO ANY OTHER PARTS OF THE PROPERTY. ON 8/27/2020, C and D loads of brick, painted block, some metal and soil were found stockpiled along the road that leads from entrance toward Interstate. These loads were just past the new building and around the corner near end of road. Once an inspection was done on 9/9/2020, the loads near the new building were spread out over the ground and blocking the road. These piles of waste must be removed and disposed of at a permitted landfill. Documentation of proper disposal must be maintained and submitted to Section staff. 6. It is not feasible nor realistic to remove all the thousands of fragmented foam, plastic and insulation pieces, leaving clean material. The facility is still doing earth work, building a new structure as well as a logging operation instead of addressing the issues itemized in recent inspections and Violation Letter. 7. Corrective consist of C and D waste needs to be removed to proper permitted facility. This facility is approved to receive YW only after conditions of compliance are complete. Mr. Gilmore has been instructed to cease accepting waste until all violations are resolved. Mr. Gilmore stated the YW that was onsite was mulched and utilized and the current vegetative material was generated onsite. Do not bring anymore material on top of the closed NLCIDLF. Remove all waste from the top of the closed NLCIDLF. Unacceptable waste removed from the closed NLCIDLF and dumped along the road in other areas must be removed and taken to properly permitted landfill. All unacceptable C and D material should be removed and taken to landfill for that waste type. Documentation for all loads will be needed to be sent to David Powell for verification they went to the appropriate Landfill. Owners need to make this a priority and complete corrective actions right away. 8. Keep documentation and take pictures. Not much progress has been made on the items mentioned in the NOV or inspections but other work continues being done. Mr. Gilmore was informed that a Notice of Continuing Violations will be forthcoming. Due to the failure to meet the conditions of compliance with the NOV and NOCV due dates, the Section will move forward with enforcement which may include civil penalties.
