ADDITIONAL COMMENTS
1. David Powell, Solid Waste Section met Scott Parks with Scotland County Solid waste to follow up on
Notice of Continuing Violation corrective actions. Mr. Leland Frizzell was onsite short time after Scott Parks and David Powell began inspecting the site. Much work has been done but much more is needed and
should be done quickly. Next step in compliance action may include fines.
2. The access road was repaired and there was proper access to the facility. This will need to be mainta ined
since there is still much work to do.
3. No new property line markers or EOW markers have been installed and no documentation showing property ownership being changed to Mr. Frizzell, have been provided. NLCID approved waste should
be inside 2 -acre footprint, covered and sloped properly. An EOW marker, PVC pipe, was visible since
some of the vegetation has been knocked down.
4. The facility is to be operated for the disposal of land clearing waste, inert debris, untreated wood and yard waste . Unacceptable waste must be removed from the property and disposed of properly at a facility permitted to receive that waste type. Maintain all disposal tickets for review by Section staff.
Industrial wood chip waste with comingled plastic still onsite, although it has been moved away from water and onto are a in which C and D waste was previously observed. It seems the C and D waste has been removed but unable to determine due to the industrial wood chips waste. DOCUMENTATION AND WEIGHT TICKETS HAVE NOT YET BEEN PROVIDED.
The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an
administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any
such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.

5. All unacceptable waste should be removed and disposed of properly. Acceptable waste must be placed within the limits of the NLCID. There is plastic and 5 gallon buckets in a few areas of the mine. Mr.
Frizzell’s staff picked up many while onsite and put into truck for removal. Please be sure and get the rest.
6. The landfill still has not been covered and properly maintained. Trees, brush and other woody vegetation were observed growing on side slopes and exposed waste was observed. Remove the trees and woody
vegetation and cover the waste in accordance to the rules.
7. At the time of this inspection, some of the side slopes for the LF appeared to be less than 3:1. The landfill should be graded and sloped properly, once the work is done on sides and atop the NLCID. After soil is added to cover exposed waste, measures must be taken to establish ground cover sufficient to restrain
erosion.

8. The total disposal area for the NLCID is to remain under two acres in size. All EOW Markers (white poles) marking the limits of the NLCID LF should be visible from one to the other to ensure that the limits of the LF do not go beyond two acres. Markers should be repaired and maintained. Any acceptable waste
beyond the markers should be pushed back into the limits of the LF, covered and provided with ground cover.
9. The property lines must be clearly marked to ensure that the 100-foot buffer is being met and maintained. Based on Scotland County GIS photos, the waste on western side of the landfill appears to be on or close to the property line and possibly within the buffer on the eastern side of the landfill as well. Some of the waste has been removed that was inside this buffer but the property line and
EOW markers must be present and visible to be able to measure the required 100 ft. buffer. 10. If this was not done, after mentioning in previous inspection, ensure that the notification is registered with the Scotland County Register of Deeds in your name in accordance with 15A NCAC 13B .0563 (2).
11. Industrial wood chip waste was brought on top the NLCID and has been spread out and starting to cover. This will be allowed ONLY ONCE, in this situation, but analysis must be provided of the contents to prove its just vegetative wood chips and nothing added. Need to see analytical results or product data sheet from manufacturer of Industrial wood chip waste to show its just clean wood. Any of the wood waste remaining outside the limits of the NLCID must be removed and placed in the LF or disposed of at site permitted by the Division.

12. Plastic bags commingled in industrial wood chip waste were brought on top of the NLCID and have somewhat been covered and must be removed. Rip rap pieces, a pipe or two, a few tires etc. were discovered on top the NLCID and must be removed. Mr. Leonard was instructed to inform Mr.
Frizzell to get analysis documentation of the industrial wood waste and remove unapproved waste atop he NLCID.
13. Corrective measures to bring this facility into compliance should be complete within 30 days’ receipt of this inspection report. Do not receive any additional waste at this site until all conditions for compliance have been met. A follow up compliance inspection will be conducted by Solid Waste
Section Staff within the next 30 days. Upon contacting Mr. Frizzell on 9/8/2020 by email, he indicated he is still working towards addressing these issues but has been slowed by Corona Virus and staffing
issues. An extension of 30 days will be giving since significant progress is being made, however the issues need to be completed soon. Failure to meet the conditions for compliance may result in further Enforcement Actions including administrative penalties.
