Operations Plan —Approved November 24, 2015 (DIN 25327) PURPOSE OF SITE VISIT: Partial Inspection - Complaint STATUS OF PAST NOTED VIOLATIONS: None Page 1 of 9 FACILITY COMPLIANCE INSPECTION REPORT e- �-,- Division of Waste Management Solid Waste Section OBSERVED VIOLATIONS: 1. 15A North Carolina Administrative Code 13B .0203(d) states: By receiving solid waste at a permitted facility, the permittee(s) shall be considered to have accepted the conditions of the permit and shall comply with the conditions of the permit. " Condition of Operating Permit Number 10 states: `An appropriate, Division of Energy, Mineral and Land Resources (DEMLR) permitfor managing any stormwater and/or wastewater at the facility must be maintained as required. Any leachate generated at the facility and any runofffrom the facility must be managed in such a manner that ground or surface water quality will not be adversely affected. The facility must be maintained to prevent the accumulation of stormwater and leachate on composting areas, storage areas, and roads. " Condition of Operating Permit Number 29 states: "Facility construction, operations or practices must not cause or result in a discharge ofpollution, dredged material, and/or fill material into waters of the state in violation of the requirements under Sections 41 and 404 of the Clean Water Act, as amended. " On August 27, 2020 Division of Water Resources staff observed that Wallace Farm, Inc. was in violation of 15A NCAC 13B .0203(d) in that leachate was discharging from the Wallace Farm, Inc. Davie County Compost Facility to an unnamed stream. While Division of Waste Management staff did not observe leachate leaving the site or leachate flowing from the leaf stockpile during the August 28, 2020 inspection, the staff did observe that leachate had been released to the unnamed stream. On August 28, 2020, Kim Sue, Environmental Senior Specialist with the Division of Waste Management, observed staining on the ground between the leaf stockpile and the unnamed stream and observed the discoloration of water in the stream. Ms. Sue also observed a growth of fungus in the stream, which is an indicator that there was an ongoing rather than a single leachate discharge to the stream prior to the leachate discharge observed by Division of Water Resources staff on August 27, 2020. 2. 15A North Carolina Administrative Code 13B .1406(4) states: "Leachate shall be contained on site or treated prior to discharge. A National Pollutant Discharge Elimination System (NPDES) permit may be required in accordance with 15A NCAC 02B prior to the discharge of leachate to surface waters. " On August 27, 2020 Division of Water Resources staff observed that Wallace Farm, Inc. was in violation of 15A NCAC 13B .0203(d) in that leachate was discharging from the Wallace Farm, Inc. Davie County Compost Facility to an unnamed stream. While Division of Waste Management staff did not observe leachate leaving the site or leachate flowing from the leaf stockpile during the August 28, 2020 inspection, the staff did observe that leachate had been released to the unnamed stream. On August 28, 2020, Kim Sue, Environmental Senior Specialist with the Division of Waste Management, observed staining on the ground between the leaf stockpile and the unnamed stream and observed the discoloration of water in the stream. To achieve compliance with 15A NCAC 13B .0203(d) and 15A NCAC 13B .1406(4), Davie County Compost Facility must submit an action plan detailing the long term plan to control leachate for the facility. The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. ADDITIONAL COMMENTS 1. On August 27, 2020 Alex Lowe and Rebecca Chandler with the NCDEQ Division of Water Resources (DWR) responded to a complaint of a substance observed in an unnamed stream on a residential property adjacent to the Davie County Compost Facility. In their investigation they observed leachate flowing from a leaf stockpile at the facility to an unnamed stream and discharging to the stream on the south side of a facility access road stream crossing. The leachate was observed flowing downstream on the north side of the stream crossing. A white substance had formed on the stream surface immediately downstream. The white substance was observed on the stream surface on the facility property and was observed on the neighboring property. 2. On August 28, 2020, an inspection was conducted in response to notification by the DWR on August 27, 2020 of the leachate discharge to the unnamed stream. Mr. Dupree stated during the inspection that he had discovered the leachate on August 26, 2020 and had discussed with facility owner, Eric Wallace, how to prevent the leachate from flowing across the road and getting into the unnamed stream. 4. During the inspection the facility access road around the leaf stockpile had been regraded and a ditch had been installed at the toe of the slope of the leaf stockpile. No leachate was observed flowing from the leaf stockpile during the inspection. Facility staff were actively bringing sandy soil to this area to build a berm on the backside of the ditch. Mr. Dupree explained that hardwood fines and mulch would be placed on the inside of the berm to soak up the leachate. Once saturated, the hardwood fines and mulch would be removed and taken to the mixing pit, and replaced with fresh hardwood fines and mulch. He added that this area would be monitored daily. (#1 on Google Earth Map) From the leaf stockpile DEQ staff followed the path where on August 27, 2020, DWR staff had observed leachate discharging to the unnamed stream at an access road stream crossing on the facility property. On August 27, 2020, DWR staff observed a white substance on the stream surface downstream in the woods. During the inspection on August 28, 2020, DEQ staff observed muddy water and no dark water upstream (south) of the discharge. A translucent film as well as whitish bubbles were observed downstream (north) in the woods and the water was a dark color. Immediately following the inspection of the facility, the unnamed stream on the neighboring property at the facility property line was inspected. The translucent film, whitish bubbles and dark water were observed at this location. (#6 on Google Earth Map) Larkin Dupree emailed DEQ staff on August 31, 2020 a photo showing the completion of the berm. Mr. Larkin indicated that the berm was successful in containing any leachate in that he stated that zero black water was leaving the site. DWR collected a sample of the white substance that was growing in the unnamed stream on August 27, 2020. It was determined that the substance is a fungus called Geotrichum and the leachate discharge to the stream was the likely cause of the excessive fungus growth. The translucent film and whitish bubbles are the initial stages of growth of the Geotrichum.
