November 2005 Limited Authorization to Place Recycling Operations on Portions of Certified Closed LCID. PURPOSE OF SITE VISIT: Partial Inspection STATUS OF PAST NOTED VIOLATIONS: NA OBSERVED VIOLATIONS: NA FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 2 of 4 ADDITIONAL COMMENTS 1. The purpose of the inspection was introducing new Solid Waste staff and Fort Bragg staff as well as inspect the CDLF and the recycling area over the closed LCIDLF. 2. A letter dated November 9, 2005, giving limited authorization to Fort Bragg for recycling operations on portions of the certified closed LCID 26G. The request from Fort Bragg, dated October 31, 2005, included stock piling clean concrete to be crushed for reuse, stock piling and grinding pallets and clean wood for mulch, stock piling and grinding yard waste and tree waste for mulch, stock piling soil for reuse, and stock piling Class “A” Bio-solids for mixing with soils and mulch for reuse. A copy of this information along with other documentation was sent to new operations staff at Fort Bragg. 3. Pallets need processing before stockpile becomes any larger. Some unapproved waste was comingled in clean pallet stockpile. Please remove unapproved waste before mulching. The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. There was a large volume of waste collected in the Yard waste collection and storage area and in need of processing. 5. Concrete stockpile is much smaller than previous visits, based on Andrew Hammonds recollection. Good job. Please continue to work at minimizing this stockpile. 6. Reminder of the “75% rule 130A-309.05. Regulated wastes; certain exclusions. Basically it means 75 % of the material, from the dated collected must be gone by end of one year. Please read entire rule for specifics and relevant requirements for the operations at this site. 7. The perimeter area of should be mowed to allow for proper inspection of slopes and MWs.
