Subject: Notice of Violation G. S. 143-215.75 Oil
Pollution and Hazardous Substance Control
Act Colonial Pipeline Company, Greensboro,
Guilford County
Dear Mr. Marder:
Chapter 143, North Carolina General Statutes,
authorizes and directs the Environmental Management
Commission of the Department of Natural Resources and
Community Development to protect and preserve the water and
air resources of the State. The Division of Environmental
Management has the delegated authority to enforce adopted
pollution control rules and regulations.
On January 23, 1989 the Winston-Salem Regional Office
(WSRO) of the North Carolina Division of Environmental
Management was notified of a spill of approximately 93,282
gallons of unleaded gasoline at the subject facility.
On January 24, 1989 staff of the WSRO visited the
facility as a follow-up to the reported spill. The
inspection indicated that the spill was contained within the
unlined dike encircling the tanks
Such a discharge is in violation of G. S. 143-215.75
et. seq. Oil Spill and Hazardous Substances Control Act.

You are requested to submit a written response to this
Notice within 15 days from receipt of this letter,
describing your plans to achieve compliance with the above
cited laws or regulations.
Failure to respond within the time specified and to
voluntarily achieve compliance may result in the
recommendation of enforcement action, including the issuance
of a special order against you under the authority of G.S.
143.215.2, or a request to the Attorney General to institute
an action for injunctive relief.
You are requested to determine the horizontal and
vertical extent of contamination and submit a proposed
remedial action plan for subject site by March 30, 1989 or
as specified in a Special Order by Consent (SOC).
Guidelines for technical and field data necessary for
developing a remedial action plan are enclosed for your use.
Only plans which contain complete requested information will
be accepted for review.
