David Powell conducted a site visit to check the progress made towards addressing issues discussed on previous visits and Notice of Violations. Don Gilmore was contacted when staff arrived onsite. Notice of Violation due date of 9/4/2020. 2. Behind parking area, just inside fence and to the right, seems to be in same condition as last inspection. A new concrete pad was poured nearby for what looks to be storage area for large fuel tank. There is still much plastic, wire, metal and other misc. items comingled in the C and D Waste onsite. 3. There is a roll off container of waste onsite from screenings based on a conversation with Mr. Gilmore. There is an infinite amount of smaller pieces of unapproved waste, such as wire, insulation and foam pieces, plastic etc., comingled with the waste on top of the Closed NLCIDLF and the area just inside fence to the right. The owners were informed at the time of the last inspection and in the Notice of Violations to process the YW and remove it from top of the closed NLCIDLF. Operating on top of a closed out solid waste facility is a violation, stop, process and remove all material. 5. At the time of the inspection on 8/27/2020, vegetative debris was found in the same location smoldering. It appeared that most of it had been recently burned. Mr. Gilmore was asked by David Powell if this was the yard waste identified during previous inspections, Mr. Gilmore stated it was not the same waste but trees from land clearing on the property. David asked what happened to the yard waste and Mr. Gilmore stated it was chipped and used onsite. There is still a good bit of material that needs processing and removal. Some mulched material was found onsite. NCDAQ will be notified of the burning. 6. The excavated C and D material was still piled onsite on top of the closed out NLCIDLF. Some unapproved wasted filled a roll off container. Again, there is an infinite amount of smaller pieces of unapproved waste, such as wire, insulation and foam pieces, plastic etc., comingled with the waste on top of the closed NLCIDLF. All waste dumped on top of the closed NLCIDLF should be removed and transported to a permitted landfill for disposal. 7. Just past the entrance to the left, beyond the new structure, there are loads of C and D material mixed with soil along the road but on the closed NLCIDLF side of the road. There are also some loads behind the closed NLCIDLF in the roadway and a load of misc. waste including lumber that’s near the mine site just past the new FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 4 of 5 structure onsite. As previously stated in conversations with Mr. Gilmore, C and D wastes are not approved for disposal on this property including any waste removed during excavation of the closed NLCIDLF. These piles of waste should be removed and disposed of at a permitted landfill. Documentation of proper disposal must be maintained and submitted to Section staff. 8. Upon leaving the site, at the entrance gate, there seems to be a new well installed. The correct buffer for any Yard Waste activity must be buffered 100 feet from any well. Please keep this in mind when locating the yard waste site and once normal operations can start again at the Dump and Go facility. 9. While staff were onsite speaking to Mr. Gilmore on the phone, it was suggested again, the most economic manner to become compliant would be to keep the larger clean block and brick, for grinding and reusing, and take everything else to a permitted Landfill for that waste type. It is not feasible nor realistic to remove all the thousands of fragmented foam, plastic and insulation pieces, leaving clean material, especially within the 60 days or less given in a NOV or NOCV to become compliant. 10. Corrective actions discussed onsite consisted of C and D waste needs to be removed to proper permitted facility. This facility is approved to receive YW only after conditions of compliance is complete. Mr. Gilmore has been instructed to cease accepting loads until it becomes compliant. Mr. Gilmore stated the YW that was onsite was mulched and utilized and the current vegetative material was generated onsite. Do not bring anymore material on top of the closed NLCIDLF. Process and remove properly what is present. Unacceptable waste removed from the closed NLCIDLF and dumped along road in other areas must be removed and taken to proper landfill. All unacceptable C and D material should be removed and take n to landfill for that waste type. Owners need to make this a priority and complete corrective actions right away. 11. Keep documentation and take pictures. Not much progress has been made on the items mentioned in the NOV or inspections but other work has been done. Mr. Gilmore was informed that a Notice of Continuing Violations will be forthcoming. Failure to meet the conditions of compliance with the NOCV due date, may result in further compliance actions which could include civil penalties.
