Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. All the fields have been cut but the hay is still on the fields at this time (currently no field available for land application). In the coming weeks establish the winter cover crop per the approved nutrient management plan. 2. There are hay bales (from a previous harvest) stored along the perimeters of the fields which need to be removed. 3. No sign of recent land application. No odors noted. No sign of land application outside the permitted boundaries. No sign of heavy application or grease burns. 4. Field markers appear adequate but it was noted that a couple posts are missing (due to recent harvest) and also that some posts have excess vegetation growing up around them which needs removed – discussed this with Mr. Markus. It appears that the approved setbacks are being met but were not measured at this time. 5. The required signs are posted and the access road is adequate. 6. The farm equipment that was previously noted as encroaching into the front of field 3 has been relocated. 7. The current name for this firm is now “Enviro Choice”. Please complete & submit the enclosed SLAS application with this current name so that a new SLAS permit may be issued under just “Enviro Choice”. 8. Soil samples shall be taken & submitted by the permit holder this fall. 9. If the required annual continuing education hours (4 hrs firm permit/3 hrs SLAS permit) have not yet been obtained then register asap for one of the remaining class locations in 2020 – contact the associations for class info.
