Pursuant to N.C.G.S. 130A-294(a2), this life-of-site permit is issued to permittee to continue operating the Uwharrie Regional Municipal Solid Landfill (MSWLF) unit. This permit shall survive the expiration of the franchise agreement (FID1404913) per N.C.G.S. 130A-294(a4). 2. The Yard Waste Facility for collecting, treating, processing, and temporary storing permitted waste stream has a 5-year permit cycle which is subject to 5-year permit amendment per N.C.G.S. 130A-294(a3)(2). 3. FID = File Identification Number. PART I: GENERAL FACILITY 1. This permit is issued by the North Carolina Department of Environmental Quality, Division of Waste Management (Division), Solid Waste Section (Section). In accordance with North Carolina Solid Waste Management Rule (Rule) 15A NCAC 13B .0201(d), a solid waste management facility permit shall have two parts: a Permit Approval to Construct and a Permit Approval to Operate. The Permit Approval to Construct must be implemented in accordance with Attachment 2 of this permit. The Permit Approval to Operate must be implemented in accordance with Attachment 3 of this permit. 2. The persons to whom this permit is issued (“permittee”) are the owners and operators of the solid waste management facility. 3. The Permit to Operate (DIN 16963) for this facility, dated November 28, 2012, was recorded by the Montgomery County Register of Deeds on February 7, 2013 in Book 711 on Page 646 (17). DIN 18653. 4. When this property is sold, leased, conveyed, or transferred in any manner, the deed or other instrument of transfer shall contain in the description section in no smaller type than that used in the body of the deed or instrument, a statement that the property has been used as a sanitary landfill and a reference by book and page to the recordation of the permit in accordance with Rule 15A NCAC 13B .0204(e). 5. By receiving waste at the facility, the permittee shall be considered to have accepted the terms and conditions of this permit in accordance with Rule 15A NCAC 13B .0203(d). Construction or operation of this solid waste management facility must be in accordance with the Solid Waste Management Rules (Rule), 15A NCAC 13B, Article 9 of the Chapter 130A of the North Carolina General Statutes (N.C.G.S. 130A-290, et seq.), the conditions contained in this permit; and the approved plan. Should the approved plan and the rules conflict, the rules shall take precedence unless specifically addressed by a permit condition. Failure to comply may result in compliance action or permit revocation. 7. This permit is issued based on the documents submitted in support of the application for permitting the facility including those identified in the “List of Documents for the Approved Plan” which constitute the approved plan for the facility. Where discrepancies exist, the most recent submittals and the Conditions of Permit shall govern. 8. Per N.C.G.S.130A-294(a1) this permit may be transferred only with the approval of the Section, through the issuance of a new or substantially amended permit in accordance with N.C.G.S.130A-294(a3). 9. In accordance with N.C.G.S. 130A-295.2(g) the permittee shall notify the Section thirty (30) days prior to any significant change in the identity or business structure of either the owner or the operator, including but not limited to a proposed transfer of ownership of the facility or a change in the parent company of the owner or a change in the operator of the facility or parent company of the operator. 10. The permittee is responsible for obtaining all permits and approvals necessary for the development of this project including, but not limited to, approval from appropriate agencies for a General or Individual National Pollutant Discharge Elimination System (NPDES) Stormwater Discharge Permit, if applicable and a sedimentation and erosion control permit. Issuance of this permit does not remove the permittee’s responsibilities for compliance with any other local, state or federal rule, regulation or statute. PART VII: MISCELLANEOUS SOLID WASTE MANAGEMENT UNIT (S) Not Applicable. ATTACHMENT 3 CONDITIONS OF PERMIT APPROVAL TO OPERATE Part I: GENERAL FACILITY OPERATION CONDITIONS 1. Pursuant to N.C.G.S. 130A-309.09A(g), the permittee must not knowingly dispose of solid wastes including municipal solid waste (MSW) and construction or demolition (C&D) solid waste that is generated within the boundaries of a unit of local government that by ordinance: a. Prohibits generators or collectors of solid waste from disposing of that type or form of solid waste. b. Requires generators or collectors of solid waste to recycle that type or form of solid waste. This facility is permitted to receive non-hazardous solid waste, as defined in N.C.G.S. 130-290 (a)(35). The permitted wastes received at the facility must be generated within the boundary of State of North Carolina consistent with the Franchise Agreement (DIN 26331) and the amendment (FID1404913), except where prohibited by North Carolina General Statutes Article 9 of Chapter 130A and the 15A NCAC 13B rules. 3. The facility operator must complete an approved operator training course in compliance with N.C.G.S. 130A-309.25. A responsible individual certified in landfill operations must always be on-site during all operating hours of the facility while open for public use. 4. The permittee must actively employ a training and screening program at the facility in accordance with N.C.G.S. 130A-295.6(g) and the approved plans (DIN 14088) for detecting and preventing the disposal of excluded or unauthorized wastes. At a minimum, the program must include: a. Random inspections of incoming loads or other comparable procedures. b. Records of any inspections. c. Training of personnel to recognize hazardous, liquid, and other excluded waste types. d. Development of a contingency plan to properly manage any identified hazardous, liquid, or other excluded or unauthorized wastes. The plan must address identification, removal, storage and final disposition of these wastes. 5. Pursuant to Rule 15A NCAC 13B.1626(5)(b), open burning solid waste is prohibited at this landfill facility. 6. Closure and post-closure activities for any landfill unit at this facility must be conducted in accordance with the approved Closure and Post-Closure Plans (DIN 6211 and 14088) and Rules 15A NCAC 13B .1627 & .1629. 7. The final closure plan must be submitted for approval at least ninety (90) days prior to closure or partial closure of any landfill unit. The plan must include all steps and measures necessary to close and maintain the landfill unit in accordance with all rules in effect at that time. At a minimum, the plan must address the following: a. Design of a final cover system in accordance with Rule 15A NCAC 13B .1627 or the solid waste management rules in effect at the time of closure. b. Construction and maintenance/operation of the final cover system and erosion control structures. c. Surface water, ground water, and explosive gas monitoring. Pursuant to N.C.G.S. 130A-295.2(g), the permittee must continuously maintain the required financial assurance for the duration of the life of the facility. The permittee must annually update and adjust closure and post-closure cost estimates and costs for potential assessment and corrective action at the landfill facility for inflation per Rules 15A NCAC 13B .1628 and N.C.G.S. 130A-295.2(h). 9. Facility construction, operations or practices must not cause or result in a discharge of pollution, dredged material, and/or fill material into waters of the state in violation of the requirements under Sections 401 and 404 of the Clean Water Act, as amended. 10. All sedimentation and erosion control activities must be conducted in accordance with the Sedimentation Control Act N.C.G.S. 113A-50, et seq. and rules promulgated under 15A NCAC 4. All required sedimentation and erosion control measures must be installed and operable to mitigate excessive on-site erosion and to prevent silt from leaving the area of the landfill unit during the service life of the facility. Modifications to the approved sedimentation and erosion control activities require approval by the North Carolina Land Quality Section. The Section must be notified of any sedimentation and erosion control plan modifications. 11. The permittee must maintain permanent physical markers that accurately identify the edge of the approved waste footprint for all active, inactive, and closed disposal units at the landfill facility. Environmental media monitoring and Reporting Requirements General Conditions 12. Groundwater, surface water, and landfill gas monitoring locations must be established and monitored as identified in the approved plans (DIN 6379 & 14088). 13. The permittee must implement the following permit conditions: a. The permittee must obtain approval from the Section for the design, installation, and abandonment of any groundwater or landfill gas monitoring well. b. Each groundwater and landfill gas monitoring wells must be surveyed in accordance with Rule 15A NCAC 13B .1632(d)(1). c. Each groundwater monitoring and landfill gas well must have an identification plate permanently attached to the well, in accordance with 15A NCAC 2C .0108(o). d. The permittee must maintain the following information in the facility operating record in accordance with Rule 15A NCAC 13B .1626(10): i) The report for each monitoring event of the groundwater, surface water, and landfill gas and pertinent analytical data. A readily accessible, unobstructed path must be maintained so that groundwater and landfill gas monitoring wells, and surface water sampling locations are accessible using four-wheel drive vehicles according to Rule 15A NCAC 13B .1626(6). f. All well construction records and soil boring logs for new wells must be submitted to the Solid Waste Section Hydrogeologist for review within 30 days of completion. g. A field logbook which details all development, sampling, repair, and all other pertinent activities associated with each monitoring well and all sampling activities associated with each surface water and leachate sampling location must be kept as part of the permanent facility record. Water Quality Monitoring and Reporting Conditions 14. Groundwater and surface water monitoring at this landfill facility must be conducted in compliance with Rules15A NCAC 13B .1630 through .1637, .0602, and the approved monitoring plan (DIN 6379). Any proposed modification to an approved plan must be submitted to the Section and approved prior to implementation. 15. Groundwater quality is subject to 15A NCAC 2L – Groundwater Classifications Standards and the Groundwater Protection Standards established under Rule 15A NCAC 13B .1634(i). Surface water is subject to 15A NCAC 2B – Surface Water and Wetlands Standards, the North Carolina Protective Values for Surface Waters, and the EPA Nationally Recommended Water Quality Criteria for Aquatic Life & Human Health. 16. Unless otherwise specified by the Section, surface water locations, and groundwater monitoring wells must be sampled at least semi-annually in accordance with Rule applicable Rules, the approved monitoring plan (DIN 6379), and the current policies and guidelines of the Section in effect at the time of sampling. 17. Monitoring reports of the analytical results for groundwater and surface water sampling events must be submitted to the Section within 120 days of the sample collection date. Analytical data must be submitted in a manner prescribed by the Section. Records of all groundwater, surface water, and leachate analytical data must be kept as part of the permanent facility record. The monitoring report and the laboratory report must be submitted in electronic format (pdf) and the analytical data must be submitted in a spreadsheet format in an Electronic Data Deliverable (EDD) Template. A potentiometric surface map for the current sampling event. b. A USGS topographic map. c. NC certified analytical laboratory reports with QA/QC information and summary tables. d. A completed Solid Waste Environmental Monitoring Data Form. e. Laboratory data submitted in accordance with the EDD Template. 18. The permittee must implement the following permit conditions: a. For a MSWLF unit. The four independent samples which comprise the initial baseline sampling event must be collected from each new installed groundwater monitoring well in accordance with Rule 15A NCAC 13B. 1633(b). b. The report including analytical data must meet the requirements stated in the Permit Condition No. 17 of Part I, Attachment 3 of this permit and be submitted to the Section for review. 19. If constituents in groundwater migrate beyond the landfill property boundary, or it is suspected to have occurred based on sampling results near the property boundary, the permittee must immediately notify all persons in writing who own land or reside on land that directly overlies any part of the contaminant plume with details of the migration. 20. The permittee must sample groundwater monitoring wells and surface water locations semi-annually unless otherwise specified by the Section. Water samples must be analyzed for constituents listed in Appendix I of 40 CFR Part 258, mercury, chloride, manganese, sulfate, iron, specific conductance, pH, temperature, alkalinity, and total dissolved solids. Sampling frequency and sampling constituents are subject to change according to requirements of the applicable corrective action program. Landfill Gas Monitoring, Management, and Reporting Conditions 21. A landfill gas monitoring event must include monitoring for all explosive gases and must be conducted at the facility including interior monitoring of on-site buildings in accordance with the approved landfill gas monitoring plan (DIN 14088) and Rule 15A NCAC 13B. .1626(4). Any proposed modification to an approved plan must be submitted to the Section Hydrogeologist for a review and approved prior to implementation. 22. Pursuant to Rule 15A NCAC 13B. 1626(4)(b), the permittee must sample landfill gas quarterly unless otherwise required for corrective action or specified by the Section. The permittee is responsible to employ properly trained personnel to conduct gas monitoring utilizing the appropriate landfill gas monitoring equipment. All landfill gas monitoring must be conducted by properly trained personnel. Landfill gas monitoring must include interior monitoring of onsite buildings. Landfill gas monitoring equipment must be calibrated according to the manufacturer’s specifications. Verification of the calibration of the landfill gas monitoring equipment is required. 24. Landfill gas monitoring results must be recorded on the Landfill Gas Monitoring Data Form which is available on the Section website and must be maintained within the facility’s operating record in accordance with Rule15A NCAC 13B .1626(10). 25. Landfill gas monitoring reports must be placed to the facility’s operating record, according to Rule15A NCAC 13B .1626(10), within 7 days of the monitoring event, and must include a description of the monitoring method used, the sampling results of each well and onsite buildings recorded in percent of the lower explosive limit (LEL), date of monitoring, weather conditions, calibration report, and signature of the sampling personnel using the Landfill Gas Monitoring Data Form which is available on the Section website. 26. A landfill gas monitoring event must include monitoring for all explosive gases and must be conducted at the facility including interior monitoring of on-site structures in accordance with the approved landfill gas monitoring plan and current Rules, policies and guidelines of the Section in effect at the time of sampling. Any proposed modification to an approved plan must be submitted to the Section Hydrogeologist for a review and approved prior to implementation. 27. If landfill gas monitoring reveals detections of methane greater than 25 percent of the LEL in on-site structures, or detections of LEL at the facility property boundary, the permittee must comply with the requirements of Rule 15A NCAC 13B 1626(4). 28. The permittee is responsible to employ or contract with properly trained personnel to operate, inspect, and maintain the constructed landfill gas collection and control system (LFGCCs) and landfill gas to energy system (LFGTE) according to the permit conditions and written protocols for monitoring, inspection & maintenance stated in the approved plans and amendments. 29. The permittee must maintain the valid permit (s) from the North Carolina Division of Air Quality and comply with any local, state or federal regulations, including routine reporting requirements, to operate the existing LFGCCs and LFGTE. Facility Permit No: 6204-MSWLF-1995 Uwharrie Regional Landfill Permit Approval to Operate Issuance Date: August 31, 2020 FID 1405130 Page 14 of 21 RECORDING AND RECORDKEEPING 30. Copies of this permit, the approved plans, and all records required to be maintained by the permittee must be maintained at the facility and made available to the Section upon request during normal business hours per Rule 15A NCAC 13B .1626(10). 31. The permittee must maintain records of the following. Scales must be used to weigh the amount of waste received. The daily reports are to be summarized into a monthly report for use in the required annual reports. a. The amount of all accepted solid waste materials as (i) MSW wastes, (ii) material used as alternate periodic cover, and (iii) recyclable material . b. Daily records of waste received and origins of the loads. 32. On or before August 1 annually, the permittee must submit an annual facility report to the Section, on forms prescribed by the Section according to N.C.G.S 130A-309.09D(b). a. The reporting period shall be for the previous year beginning July 1 and ending June 30. b. The annual facility report must list the amount of waste received and landfilled in tons and be compiled: i) On a monthly basis. ii) By county, city or transfer station of origin. iii) By specific waste type. iv) By disposal location within the facility. v) By diversion to alternative management facilities. c. A measurement of volume utilized in the landfill cells must be performed during the first or second quarter of the calendar year. The date and volumes, in cubic yards, must be included in the report. d. The amount of waste, in tons from scale records, disposed in landfill cells from December 11, 1995 through the date of the annual volume survey must be included in the report. e. The tons of waste recycled, recovered or diverted from disposal including a description of how and where the material was ultimately managed, as applicable, must be included in the report. f. The completed report must be forwarded to the Regional Senior Environmental Specialist for the facility by the date due on the prescribed annual facility report form. A copy of the completed report must be forwarded to each county manager for each county from which waste was received at the facility. Documentation that a copy of the report has been forwarded to the county managers must be sent to the Regional Senior Environmental Specialist by the date due on the prescribed annual facility report form. PART II: MUNICIPAL SOLID WASTE LANDFILL UNIT(S) 6204-MSWLF-1995, Uwharrie Regional MSW Landfill 1. The life-of-site Permit Approval to Operate (PTO), as defined in N.C.G.S. 130A-294(a2), for the continued operations of the MSWLF unit – Cells 1 through 14/Phases 1 through 4, that are described below, shall expire on December 11, 2055. a. The existing MSWLF unit Phase 1, 2, 3 and 4, consisting of Cells 1 through 14 having approximately 146.2-acre waste footprint and 21,305,000 CY gross capacity as shown on drawing Sheets 6, 10, and 11 of 20 (DIN 6211 & 28404). b. The areas (Cells 1 through 5) encompassing 39.1 acres are closed by constructed approved final cover system (DIN 19356, 19357, 19999). The partial closure areas shall be subjected to post-closure care requirements according to the Permit Condition Nos. 17 through 21 in this part, Attachment 3 of this permit. 2. Operation of any future phases or cells of the MSWLF unit – Phases 5 & 6 for life-of-site permit under N.C.G.S. 130A-294(a2) requires written approval of the Section. Application for Permit Approval to Operate must be prepared in accordance with applicable statutes and rules in effect on that date. 3. The MSWLF unit must not accept the following type wastes, at a minimum, for disposal: hazardous waste as defined by N.C.G.S. 130A-290(a)(8), PCB waste as defined in 40 CFR 761, wastes banned from disposal according to N.C.G.S. 130A-309.10(f), and wastes banned by the Franchise Agreement (DIN 26331) and its amendment (FID 1404913). 4. Spoiled food, animal carcasses, slaughterhouse or hatchery waste, or other animal waste received must be immediately buried and covered with a layer of soil followed by non-putrescible municipal solid waste in accordance with Rule 15A NCAC 13B .1626(1)(c). 5. Regulated asbestos-containing material as defined in 40 CFR 61 must be managed in accordance with 40 CFR 61. Disposal of asbestos waste must be in accordance with Rule 15A NCAC 13B .1626(1)(d). 6. The MSWLF unit is permitted to co-dispose of wastewater treatment sludge generated within the facility's approved service area as defined in the Permit Condition No. 2, Part 1 Attachment 3 of this permit, subject to the terms and procedures of the approved plan and Rule 15A NCAC 13B .1626(1)(e). Facility Permit No: 6204-MSWLF-1995 Uwharrie Regional Landfill Permit Approval to Operate Issuance Date: August 31, 2020 FID 1405130 Page 16 of 21 7. The facility is approved to accept permit wastes at an average rate of approximately 3,000 tons per day or approximately 1,095,000 tons per year based on 365 operating days which is consistence with the Franchise Agreement (DIN 26331) and its amendment (FID 1404913). Maximum variance shall be in accordance with N.C.G.S. 130A-294(b1)(1). 8. The MSWLF unit approves to use the following alternative daily cover (ADC): a fabric tarp, petroleum contaminated soil, the material known as “Posi-Shell,” and foundry sand. In accordance with N.C.G.S. 130A-295.6 this landfill however may use an ADC that has been previously approved for use at other sanitary landfills in North Carolina. The Section maintains a list of approved ADC and its appropriate use, which may be referred to, but is not required to be, in determining ADC types and uses. 9. The use of ADC that does not meet the requirements stated in N.C.G.S. 130A-295.6 requires approval, prior to implementation, by the Section. Requests for ADC approval must include a plan detailing the comprehensive use and a demonstration of the effectiveness of the alternative cover, developed according to Section guidelines. Plans that are approved by the Section will be incorporated into, and made a part of, the approved documents listed in Attachment 1. 10. The permittee must maintain records for all solid waste materials accepted and used as ADC. The records must include: the date of receipt, weight of material, general description of the material, identity of the generator and transporter, and county of origin. Such records must be made available to the Section upon request. The application of ADC materials in excess of normal application of daily cover of the material shall constitute disposal. 11. The leachate collection and removal system including the on-site above-ground leachate collection tanks must be periodically cleaned and maintained in accordance with Rules 15A NCAC 13B .1626(12)(a) & .1680 and N.C.G.S. 130A-295.6(h)(3). Remote camera inspections of leachate lines shall occur upon completion of the construction and at least once every five years. Documentation of the inspections, and cleaning and monitoring must be included in the operating records of the facility and provided to the Section upon request. 12. The use of leachate recirculation as a leachate management tool is approved at the landfill unit – Cells 1A, 2A, 3A, 9, 13 & 14 which have at least 10-feet-thick disposed wastes and been constructed with the base liner system meeting the requirements stated in Rule 15A NCAC 13B .1624(b)(1)(A)(i). The maximum leachate circulation rate is 5 gallons per square foot of the approved cell areas. Leachate recirculation including routine operation, inspection, maintenance, and recordkeeping shall be conducted according to the terms and procedures of the approved plan (DIN 14088) and as per 15A NCAC 13B .1626(9)(a)(ii). Facility Permit No: 6204-MSWLF-1995 Uwharrie Regional Landfill Permit Approval to Operate Issuance Date: August 31, 2020 FID 1405130 Page 17 of 21 a. Leachate recirculation at the inactive or partial closure landfill cells - Cells 1A, 2A, 3A, 9 is permitted only by one method - subsurface infiltration trenches. b. Leachate recirculation at the active working face of landfill cells - Cells 1A, 2A, 3A, 9, 13, or 14 is permitted by three methods - subsurface infiltration trenches. haul truck with spray nozzles or directly spray on wastes. 13. Untreated leachate must be sampled and analyzed at least semi-annually concurrently with the groundwater water and surface water sampling. The leachate must be analyzed for all Appendix I constituents, pH, specific conductance, BOD, COD, nitrates, sulfates, and phosphates. Test results must be submitted to the Section along with groundwater and surface water test results. In the event leachate is recirculated, additional leachate sampling may be required as stated in the approved plan (DIN 14088). 14. The permittee shall begin sampling of the seep at the discharge point of the underdrain pipe underneath Cell 14B as shown on the as-built drawing Figure 1 (DIN 28404). The seep must be sampled and analyzed at least semi-annually in July 2017 concurrently with the groundwater water and surface water sampling and according to the plan (DIN 27540). The seep must be analyzed for all Appendix I constituents, pH, specific conductance, BOD, COD, nitrates, sulfates, and phosphates. Test results must be submitted to the Section along with groundwater and surface water test results. 15. The permittee shall continuously monitor, measure the flow rate, and document the seep condition discharged from the underdrain pipe underneath the Cell 14B. The activities must be conducted at least on monthly basis for a minimum timeframe of twelve (12) months upon completion of the underdrain pipe installation according to the approved plan (DIN 27540). The record of monthly precipitation shall be documented along with the seep data. All recorded data must be placed in the operating record and provided in the Permit Approval to Construct Application for the landfill future phase or cell (Cells 15 or 16). Interim Post-Closure Maintenance Conditions 16. The partial closure areas of approximately 39.1 acres at the MSWLF unit are summarized in the table below and described in the certification documents in Part I of Attachment 1 of this permit. Because the areas are only a partial closure of the landfill unit, the required 30-year post-closure period shall not commence until the certified closure date of all landfill cells located at the site. Nevertheless, the permittee is responsible for the maintenance activities at the closed area according to the approved post-closure plans (DIN 6211 and14088). The permittee must provide continuous coverage for post-closure care for the 39.1-acre partial closure area in accordance with Rule 15A NCAC 13B.1628(c) until released from financial assurance requirements for post-closure care by demonstrating compliance with Rule 15A NCAC .1627(d)(3). 18. The required post-closure maintenance for this facility shall consist of whatever measures, procedures, and activities required to maintain this facility in compliance with those closure conditions included in Rules 15A NCAC 13B .1627, .1628, and .1629 including: a. Maintain the integrity and effectiveness of the approved cap system including making timely repairs to the cover as necessary to address settlement, subsidence, erosion, or other events, and to preventing stormwater run-on and run-off from eroding or otherwise damaging the cap system in accordance with Rule 15A NCAC 13B .1627(d)(1)(A). a. Maintain and operate the leachate collection system in accordance with the requirements in Rule 15A NCAC 13B .1627(d)(1)(B). b. Maintain and, at a minimum, perform semi-annual sampling and analysis of the approved ground water monitoring and surface water system in accordance with Rule 15A NCAC 13B .1627(d)(1)(C) and Permit Condition Nos. 13 through 17, Part 1 of Attachment 3 of this permit. d. Maintain and operate the gas monitoring system in accordance with Rule 15A NCAC 13B .1627(d)(1)(D) and Permit Condition Nos. 18 through 24, Part 1 of Attachment 3 of this permit. 19. The permittee must ensure that continuing solid waste management activities, including the operation of the remaining portions of the landfill unit within the landfill facility, must be conducted in accordance with all pertinent requirements stated in the 15A NCAC 13B Rules, permit conditions, and must not violate any post-closure conditions. 20. Pursuant to Rule 15A NCAC 13B .1629(c)(3), the permittee must not disturb the integrity of the final cap system or the function of the monitoring systems unless specifically approved by the Division when the closed area is planning for other post-closure land uses. PART IV: INDUSTRIAL LANDFILL UNIT(S) Not Applicable. PART V: LAND CLEARING AND INERT DEBRIS LANDFILL UNIT(S) Not Applicable. PART VI: TRANSFER STATION/TREATMENT & PROCESSING UNIT(S) 6204-TP-2011, Yard Waste Collection Facility 1. The five (5)-year Permit Approval to Operate the on-site yard waste collection, treatment and process facility shall expire on May 14, 2025. Pursuant to N.C.G.S 130A 294(a3)(2), the permittee shall submit a written request to the Section for a five (5)-year renewal of the permit. The permittee shall operate and manage the facility according to Rule 15A NCAC 13B .0302, .1402(g)(1), and the approved plans (DIN 14088). 2. The permitted waste streams that are generated from the State of North Carolina include land clearing debris, yard waste, and wooden pallets as defined in Rules 15A NCAC 13B .0101(23) and (56) and N.C.G.S. 130A-290(44a), respectively. The permitted waste streams also include untreated and unpainted wood waste, and vegetative, unprocessed agricultural waste. 3. The permittee must conduct random waste screening processes according to the approved Operations Plan (DIN 14088) to ensure that prohibited wastes are identified and removed to designated areas for proper disposal at the end of each working day. 4. Each windrow/stockpile shall be maintained a. At least 25-foot clear distance or perimeter from drainage ditches and swales, around the processing area, and other stockpiles of raw wastes and ground material to allow for inspection, monitoring temperature, or firefighting. The isle distance shall be adjusted or modified at the local fire marshal’s instruction. b. Manageable dimensions including the maximum height of each stockpile which shall be adjusted or modified at the local fire marshal’s instruction. 5. The facility is permitted to operate a treatment and processing unit as defined in Rule 15A NCAC 13B .0101(49). The operation consists of a grinder for permitted wastes. Grinding of the collected waste material shall take place at least once every 18 months. No grinding of wastes shall be taken place in a rainy or windy day. 6. The grounded material such as mulch a. May be used for amending soils used on intermediate or slopes of the landfill final cover system or may be used as an ADC according to N.C.G.S. 130A-295.6. Facility Permit No: 6204-MSWLF-1995 Uwharrie Regional Landfill Permit Approval to Operate Issuance Date: August 31, 2020 FID 1405130 Page 20 of 21 b. Can NOT be distributed to the general public. 7. Composting of the permitted wastes or grounded material at this facility is PROHIBITED, and the grounded material SHALL NOT be disposed of in the active landfill. PART VII: MISCELLANEOUS SOLID WASTE MANAGEMENT 1. Recovered or recyclable material shall be temporary stockpiled in the designated area as shown on drawing Sheet 3 of 13 (DIN 12785) and managed as a valuable commodity in a manner consistent with the desired use or end use. The permittee must operate and manage received recyclables or recovered material at this facility according to the requirements set forth in N.C.G.S. 130A-309.05(c)(1), (2), (3), & (4) and the approved plan (DIN 14088). 2. Seventy-five present (75%), by weight, of the recovered material stored at the facility at the beginning of a calendar year commencing January 1, must be removed from the facility through sale, use, or reuse by December 31 of the same year. 3. Surface water shall be diverted from all operational and storage areas to prevent standing water in operational areas and under or around storage piles. Water that comes in contact with solid waste is deemed to be leachate and shall be contained on-site or properly treated prior to discharge. 4. These areas shall be operated and maintained with sufficient dust control measures to minimize airborne emissions and to prevent dust from becoming a nuisance or safety hazard. 5. These areas shall be operated and maintained in a manner so as to minimize odors, prevent the creation of a nuisance, potential health hazard, or a potential fire hazard. 6. Effective vector control measures shall be applied as necessary to control flies, rodents, insects, and vermin. OPERATIONAL CONDITIONS – SCRAP TIRE COLLECTION UNIT 7. The unit is permitted to receive scrap tire as defined in N.C.G.S. 130A-309.53(6) and the collected scrap tires must be temporarily stored inside trailer(s) at the designated area. 8. The collected tires are directly stored inside a trailer(s) per Rule 15A NCAC 13B .1105 (d) and the Operation Plan (DIN 14088); therefore, the permittee shall operate the unit in accordance with the requirements of Rule 15A NCAC 13B .1106(c)(3) & (c)(5). Once one or more trailers are full, the permittee must contract a tire recycler/hauler to transfer the tire trailer(s) to the permitted tire recycling/processing facility. OPERATIONAL CONDITIONS – WHITE GOODS & SCRAP METAL UNIT 10. The unit is permitted to receive and to temporary store white goods as defined in N.C.G.S. Article 9, Chapter 130A-290(a)(44) and scrap metals in roll-off containers or equivalent at the designated area. The permittee must manage the white goods in accordance with the approved plan (DIN 14088) and all applicable statutes and rules of the State of North Carolina. 11. The permittee must separately store the white goods containing Freon from the non-Freon white goods and scrap metal at this unit and will work to ensure that the white goods containing chlorofluorocarbon refrigerants (Freon) are properly stored in good condition. The collected white goods must be shipped to the off-site recycling facilities at least once a year. The off-site recycling facility is responsible for removal of Freon inside the received white goods. - End of Section – ATTACHMENT 4 CONDITIONS OF PERMIT FOR CLOSURE Not Applicable - End of Permit Conditions -
