The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance
with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an
administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit,
or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to
enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any
such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.
ADDITIONAL COMMENTS
1. The C&D landfill unit is currently inactive due to a reduction in staff and down equipment. All C&D waste is being
placed in the MSW landfill.
2. Facility staff stated the last time C&D waste was disposed of in this unit was April -May 2019.
3. All access roads are maintained in good condition.
4. No ponding of water on the landfill was observed.
5. The facility had applied intermediate cover and stabilized with vegetative ground cover per 15A NCAC 13B
.0542(f)(2).
6. The landfill had good vegetative cover except for two areas that had developed erosion rills: one on the southeast
slope and one on the east slope of the landfill.
7. The east side slope of the landfill had developed erosion rills exposing waste. Facility staff were actively applying
soil to this area. Several areas on top were pointed out to facility staff where the equipment had exposed waste. Mr.
Bivins stated he would provide pictures at the end of the working day for all areas.
8. Facility staff plan to hydro seed all areas where vegetative cover has not taken hold.
