Solid Waste Director John College - NCDEQ-DWM-SWS-FOB STATUS OF PERMIT: Notified site. No permit required. PURPOSE OF SITE VISIT: Follow-up Facility Compliance Inspection. STATUS OF PAST NOTED VIOLATIONS: Corrective action has been done. OBSERVED VIOLATIONS: No new violations. The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 2 of 4 ADDITIONAL COMMENTS: 01 - This site visit was a follow-up inspection to the compliance inspection conducted on August 11, 2020 with Observed Violation still needing to be corrected within 30 days as stated on the June 30, 2020 inspection report. 02 - On August 12, 2020, John College notified Mr. David Cross – (Manager) Twiford IV, LLC (landowner) – of the non-compliance on the Notified Land Clearing and Inert Debris Landfill (LCID) on the Twiford property. 03 - Mr. Cross and John College set up another inspection for August 25, 2020 to discuss these violations with Mr. Sanders and to develop a Plan of Action to bring this facility into compliance. 04 - John College ask Brad Gardner - Pasquotank Co. Solid Waste Director to attend this meeting in Pasquotank Co. 05 - Upon arrival of this facility inspection, ALL of the quoted violations from the June 30, 2020 inspection have been resolved by Mr. Sanders. 06 - During this facility inspection Mr. Sanders stated that he wants to close out this Notified LCID. 07 - To close out this facility, the side slopes must be graded to have (at a minimum) a 3:1 grade. 08 - All the waste must be covered with 1 ft. of earthen material (soil) and seeded to establish vegetation to prevent erosion of this facility. 09 - A letter certifying that all of the above criteria has been met and mailed to John College. Box 782, Columbia N.C. 27925. 10 - Upon receipt of this certification letter, John College will set up a final inspection to bore test holes to ensure the 1 ft. of cover has been met. 11 - Digital pictures will be taken and attached to the inspection report. 12 - A formal letter will be sent confirming closure of this facility and it would be a violation if used for waste storage after closure.
