OBSERVED VIOLATIONS: 1. 15A NCAC 13B .0838 (i) states: The area around tanks shall be free of debris and vegetation to allow for access and inspection for a distance of 5 feet. Bates Septic Tank & Concrete Products Co was in violation of 15A NCAC 13B .0841 (i) for failure to keep the area around the septage detention tanks free of vegetation to allow for access and inspection for a distance of at least 5 feet. In order to come into compliance, Bates Septic Tank & Concrete Products Co must clear the vegetation from around the tank to a distance of five feet and submit photos of the completed work by September 14, 2020. You may submit the photos to: troy.harrison@ncdenr.gov FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 2 of 3 2. 15A NCAC 13B .0838 (k) states: “Access roads or paths crossing or leading to the facility shall be posted with "NO TRESPASSING" signs.” Bates Septic Tank & Concrete Products Co was in violation of 15A NCAC 13B .0841 (k) for failure to have a “No Trespassing” sign posted either at the tank or at the entrance to the facility. In order to come into compliance, Bates Septic Tank & Concrete Products Co must a “No Trespassing” sign posted either at the tank or at the entrance to the facility and submit photos of the completed work by September 14, 2020. You may submit the photos to: troy.harrison@ncdenr.gov ADDITIONAL COMMENTS 1. The Septage Detention and Treatment facility (SDTF) consisted of one 4,000 gallon above ground steel tanks for storage of domestic septage and portable toilet waste. Photos by Troy Harrison 2. It appears that set-back/buffer requirements appear to have been met. 3. The “No Trespassing” sign was not observed during the inspection. This will need to be replaced. 4. All weather roads are maintained for access to the site. 5. The tank appeared to be structurally sound. 6. The area around the tank was found to be free of spills. 7. Vegetation was observed around the tank during the inspection. State regulations require that vegetation be kept clear from around the tank to a distance of 5 feet. This was also observed during the previous inspection. 8. No odors were observed around the tank. The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.
