STATUS OF PERMIT: Notified LCID PURPOSE OF SITE VISIT: Comprehensive Follow up Inspection STATUS OF PAST NOTED VIOLATIONS: N/A OBSERVED VIOLATIONS: N/A The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. Boundaries of the less than 2-acre notified area and edge of waste were measure using Laser Range Finder and were satisfactory. 2. Dawson indicated he has not been accepting loads since about the last inspection on 4/27/2020. Mr. Dawson has excavated the material from the backside of the LCID and applied it on top and somewhat compacted. He has attempted to regrade/slope better but more is needed as well as covering the exposed waste properly. 3. Taller EOW markers installed as requested, now longer PVC pipes. Thank you. 4. Upon inspecting the site Mr. Dawson inquired about a short term operation he wishes to start to assist in recovering topsoil, fixing the issues in the LCID that have been mentioned as well as recover some capacity. That would involve “Old Castle”, neighboring grinding company, to bring a trailer over and leave at the Dawson LCID, Mr. Dawson would then excavate further and deeper into the landfill to bring out stumps and larger logs to put onto the trailer for Old Castle to utilize in their mulching operation. While onsite David Powell, informed Mr. Dawson he would need to inquire with Drew Hammonds to be sure no rules would be violated in this operation. David Powell discussed this and the current conditions of the site with Supervisor Drew Hammonds. 5. The Section doesn’t see any issues with this operation, given Mr. Dawson keeps the working area small and covers the current exposed waste before continuing, keeps all waste inside the approved less than 2-acre footprint and has erosion control measures in place. Once the LCID exposed waste is covered, then Mr. Dawson should begin his excavating operation and should keep the working area to a minimum. When moving to new areas, compact and cover previously disturbed areas to minimize surface area of exposed waste and time that waste is left exposed to keep within the rules. Vegetation should be reestablished also according to rule. 6. Mr. Dawson stated he would inform David Powell once the excavation was done and regular operation was going to resume. Refer to rules and requirements 15A NCAC 13B .0563, .0564, and .0566 sent by email to dsdawsoncpa@aol.com on 8/20/2020 for review by Mr. Dawson. Front two corner EOW markers. This needs to be covered immediately.
