Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. Amanda Freeman and David Powell, with the Section, inspected facility while also investigating neighboring open area for debris site (DS78-035). 2. Site was open and free of debris. Good job. Section staff didn’t review time and temperature records for compost material that has been on the site in the recent past. If not taking time and temps please do so, as it is stated in the YWN renewal from and this is required for any material making it to the public. 3. In the event of a disaster and you call or email to activate the debris site, be sure to the disaster debris separate from YW material. Be sure to always keep YW material inside of the approved 2 acre or less area always. 4. Upon review of National Wetland Inventory for Debris site, a wetland feature was found near and behind what is now being used as the Yard Waste Notification site. See attached map in DS78-035 Mt. Tabor Rd. Disaster Debris Site packet recently sent. Pictures were taken as seen below. Be mindful to keep material and any leachate from this area. Aerial photos from the past show lots of material potentially in this area. As suggested with the Debris site, the YWN site also needs corner markers large enough for Section staff and town staff to see and know where is the approved area. 5. Also while visiting the Yard Waste site, a roll off container was filled with waste at the back of the circular drive. It was rusted out on the bottom and should be disposed of immediately. Any rain water comingling with the waste can leak out and cause leachate issue to the surrounding area. Yard Waste area clear of material. Bright green area is about where the wetland is located. Roll off full of waste at back side of property along circle drive access road.
