OBSERVED VIOLATIONS:
1) Upon review of the submitted land application records, it was noted that the monthly application rates
were exceeded once in 2015, 2016, and 2018. Exceeding the monthly application rate is a violation of
Rule .0842(a)(17) that states “approved nutrient management plans shall be followed.”
The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.

ADDITIONAL COMMENTS
1) Land application logs for July 2014 through March 2019 were submitted along with the application for
permit renewal. For Field 3 in 2015, the monthly application rate of 5,000 gal/ac for October was
exceeded. Records showed that 11,480 was applied to Field 3 in October of 2015. At a monthly rate of
5,000 gal/ac, only 10,000 gallons should have been applied to Field 3 in October (5,000 gal/ac * 2 ac =
10,000 gal).
In 2016 for Field 3, the monthly application rate of 5,000 gal/ac for February was exceeded. Records
showed that 11,820 was applied to Field 3 in February of 2016. At a monthly rate of 5,000 gal/ac, only
10,000 gallons should have been applied to Field 3 in February (5,000 gal/ac * 2 ac = 10,000 gal).
In 2018 for Field 2A, the monthly application rate of 5,000 gal/ac for August was exceeded. Records
showed that 10,180 was applied to Field 2A in August of 2018. At a monthly rate of 5,000 gal/ac, only
9,500 gallons should have been applied to Field 2A in August (5,000 gal/ac * 1.9 ac = 9,500 gal).
The monthly amount applied to each field was typically below the monthly application rate. The
maximum application rate was not exceeded for the site or any field from 2015 through 2018. Please
watch the amount you apply each month so that you do not exceed your monthly application rates.
