PURPOSE OF SITE VISIT: Follow up Partial Inspection STATUS OF PAST NOTED VIOLATIONS: 15A NCAC 13B .0542 (l) (4) - RESOLVED 15A NCAC 13B .0542 (f)(1) - RESOLVED OBSERVED VIOLATIONS: NA FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 2 of 5 ADDITIONAL COMMENTS 1. Inspection was to follow up on seep on C and D LF and to do a “Shut Down” with staff at Robeson County LF. 2. Southwest side of LF had a seep in which leachate was ponded outside of Edge of Waste. LF Staff were quick the evening of July 10, 2020 to remove soil and fix seep. Currently covering LF with soil. 3. 7803-CDLF-1997 over Closed 7803-MSWLF-1985 – Permit expired May 28, 2020. Renewal was submitted by the County around end of March 2017. New permit is being processed currently and should be out to Permittee soon. 4. Edge of Waste (EOW) markers were not visible around footprint of LF. Vegetation needs to be mowed more frequently so that EOW markers are visible and Facility staff can conduct proper inspections of the landfill toe and perimeter. This was taken on North side of C and D/Closed MSW LF. Once the vegetation gets this high the person who mows may not see it and may cause damage upon mowing waiting this long. The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 3 of 5 5. MMW 4A, MW 11, and MMW 4 were inspected while looking at C and D seep corrective actions. All seemed to be in good shape. No damage and had ID cards. However, the lock on MMW 4 was not properly secured and was easily opened. These should be inspected, maintained and monitored for damage regularly to ensure security of the wells. 6. Treatment and Processing Unit had considerable amount of unapproved wastes. LF staff worked over weekend to clean up this area. However, it is now waste in water which was a problem discussed in July 10, 2020, inspection in regards to the NLCID. Only clean unpainted and untreated pallet wood should be taken. The staging of this activity should be placed at the approved location in the permit. Contact Ben Jackson, Permitting Branch, to ensure this area is approved in the new permit. FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 4 of 5 Permit Attachment 3, Part IV (106) - The facility is permitted to receive wooden pallets constructed of unpainted and untreated natural wood. 7. Currently the approved staging for Mobile Home (MH) Deconstruction is East of the NLCID in the Borrow Pit. Thirteen Mobile Homes awaiting deconstruction were staged South of the CDLF. Changes to the Approved Operations plan must have approval from Section Permitting before implementation. Operations Plan and Permit will need to be approved and updated. Previous Permit, issued June 10, 2015, state that MH’s should be deconstructed within 45 days of acceptance and staged at the approved area. Permit Attachment 3, Part VII. 98. Storage of mobile homes, recyclable materials and deconstruction activities shall take place only in the designated mobile home deconstruction area, which shall be a graded area within the C&D unit. Robeson County shall notify the facility Waste Management Specialist, and receive approval, prior to moving the deconstruction activities from within the C&D unit, and shall modify the approved plan prior to changing the designated area. 99. All mobile homes must be deconstructed within 45 days from acceptance into the deconstruction area. The date of receipt at the landfill shall be posted on the mobile home or its frame. Staff did not verify dates on frames or when these MH arrived. This will be checked during follow-up inspection. 101. Recyclable materials may be stockpiled at the mobile home deconstruction area for no more than 45 days from the date of deconstruction. It would be beneficial to review Permit application that was submitted for Robeson County back in 2017 to ensure that it still aligns with the goals and current operations capabilities of the Robeson County landfill. When the CDLF permit is issued, be sure to read and review, and ensure it aligns with current practices and any changes that may be difficult or problematic can be addressed with permitting before they become troublesome. Any issues can be worked out, and avoid the County getting into further compliance issues. Corrective measures to bring this facility into compliance should be complete within 30 days’ receipt of this inspection report. A follow up compliance inspection will be conducted by Solid Waste Section Staff within 30 days. Failure to meet the conditions for compliance may result in Compliance Actions.
