STATUS OF PERMIT:
Notified site. No permit required. PURPOSE OF SITE VISIT: Follow-up Facility Compliance Inspection. STATUS OF PAST NOTED VIOLATIONS: No attempt made to correct observed violations from the June 30, 2020 inspection documented on the inspection report. This report was sent to Ken Elliott, Elliott Consulting to be forwarded to Mr. Jake Sanders by Mr. Elliott. OBSERVED VIOLATIONS:
15A NCAC 13B .0566 OPERATIONAL REQ. FOR LAND CLEARING/INERT DEBRIS (LCID) LANDFILLS: (4) Adequate soil cover shall be applied monthly, or when the active area reaches one acre in size, whichever occurs first. (16) A sign shall be posted at the facility entrance showing the contact name and number in case of an emergency and the permit number. The permit number requirement is not applicable for facilities not requiring an individual permit.

ADDITIONAL COMMENTS: 01 – This site visit was a follow-up inspection to the compliance inspection conducted on June 30, 2020 with Observed Violation needing to be corrected within 30 days as stated on the June 30, 2020 inspection report.
02 – Mr. Elliott confirmed to John College (per phone call on 8/11/2020) that he forwarded the inspection report to Mr. Sanders. 03 – On August 12, 2020, John College notified Mr. David Cross – (Manager) Twiford IV, LLC (landowner) – of the
non-compliance on the Notified Land Clearing and Inert Debris Landfill (LCID) on the Twiford property. 04 – Also noted was other Solid Waste (Scrap Tires, Scrap Metal and Construction and Demolition Waste) on other areas of the property outside of the Notified LCID that was in need of removal to a permitted landfill. 05 – Mr. Cross was out of town until August 14, 2020 and will be contacting Mr. Sanders to ensure these observed violations are corrected when he returns. 06 – On August 12, 2020, John College sent copies of inspection reports (pictures attached) and copy of Solid Waste Rules to Mr. Cross for his review. 07 – Also on August 12, 2020, John College requested an onsite meeting with Mr. Sanders, Mr. Cross and Mr. Elliott to discuss these observed violations and have a 30 Day Plan of Action written and submitted to John College to avoid a Notice of Violation to be issued, due to the landowner was not aware of these issues. 08 – Moving forward, ALL Inspection Reports will be sent to Twiford IV, LLC (David Cross) and any other documents that is addressing issues on this property. 09 – Mr. Cross has assured John College these observed violations and other issues will be resolved. 10 – Digital pictures were taken during this follow up inspection with several attached to this report.

Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.
