STATUS OF PAST NOTED VIOLATIONS:
NOD issued June 11, 2020. The cattle have been removed from Field 1. An amendment to the nutrient
management plan to include grazing has been signed/added to the nutrient management plan. The hay bales
have been removed from the perimeter of Field 2. Field 2 has been cut since the last site visit.

The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance
with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an
administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit,
or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to
enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any
such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.

ADDITIONAL COMMENTS
1. Cattle may now be placed on the permitted disposal fields in accordance with the 30 day wait after the last
discharge event. During this visit the cattle were located in the horse pasture. The fields will need to be
harvested soon. Weed control is needed in some areas.
2. Met to discuss the proposed permit modification for a field expansion to the north side of the site. I have
received a soil report for this new area. I have not yet received a SLAS application as previously
requested (gave Frankie Jones an application form). As previously requested I have not yet received
confirmation that the original site evaluation includes this new area to the north. Reviewed the previous
site evaluation and site maps & discussed the situation. If this area was not included in the original site
evaluation then a new site evaluation will need to be done on this area to the north side of the site – gave
Frankie Jones a copy of the original site evaluation, a list of licensed soil scientist & a copy of the Septage
Rules. After these items are addressed then a revised nutrient management plan (to include the third field) and a
pre-operational inspection (to establish the new site boundaries) will be handled.
3. As noted on the previous audit report of August 16, 2019 Rule .0841(d)(15) states that the 500 feet
setback from a disposal field to a well can be reduced to 250 feet when the land within the setback area
has 95% permanent established grass or forest cover. As noted on that previous audit report of August
16, 2019 the required distance for a well at the playground area on the far side of the creek to the disposal
field would have to be 500 feet because there is not permanent established grass/forest cover (there is the
access road). The well that has been recently installed across from the playground area along the access
path shall have to be permanently closed or a 500 feet setback established to the disposal fields. As also
noted on the previous audit of August 16, 2019 the required distance from a well at Mr. Jones proposed house to
a disposal field could be 250 feet if there is permanent established groundcover in between.
4. A Countywide Septic Services Inc. has an authorization to discharge on this septage land application site.
However per Rule .0842(e)(3) a copy of the land application site logs shall be submitted monthly if any
firm other than Belton’s Septic Tank Service discharges on this site. Discussed this requirement with Terry
Jones who indicated that he would start submitting the land application site logs.
5. Discussed with Frankie Jones that soil samples shall be taken on the two permitted fields & submitted to the lab
this fall. Mr. Jones also stated that he is registered to attend the Shallotte training class this fall.
