Dear Mr. Coffey:
Champion has received your October 25, 1999 letter in which the Solid Waste Section
made the determination that the above referenced landfill was closed in accordance
with the applicable requirements and is now considered closed, subject to certain post
closure conditions. The effective date of closure is determined by your receipt of the
following notice:
Champion intends to maintain the facility in compliance with the post closure
conditions specified in your letter of October 25, 1999.
As you are aware, this landfill stopped receiving waste in 1991 and has been awaiting
a closure determination from the Solid Waste Section for many years. During the
interim period, semi-annual ground water and surface water monitoring has been
continued, with results reported to the Solid Waste Section. Routine inspections were
also conducted during this time by your Section. Because this information has been
collected over a nine year period following the physical closure of the landfill,
Champion intends to seek special consideration from your office regarding the
standard post closure condition requiring at least five additional years of water quality
monitoring from this point forward. Pending that request and your determination,
Champion will continue semi-annual monitoring as specified in the post closure
conditions.
Thank you for your assistance in bringing this matter to closure. I will call your office
to seek advice as to how Champion might pursue its request for consideration
regarding the post closure water quality monitoring period.

Dear Mr. Ross:
The Solid Waste Section (the Section) has reviewed the closure
documentation and has determined that the referenced industrial waste landfill has
been closed in accordance with the applicable requirements.
The landfill is considered closed subject to the following post -closure
conditions. The owner and/or operator of the facility, Champion International, is
responsible for compliance with these conditions. In particular, Condition # 7
requires that, if the permit has not been previously recorded in accordance with
Rule .0204, documentation shall be provided that a statement that the property has
been used as a sanitary landfill is contained in the legal description of the landfill
site. The legal description should be sufficient as a description in an instrument of
conveyance and the statement shall be in no smaller type than that used in the body
of the of the deed or instrument. Condition #8 addresses continued water quality
monitoring for the existing ground water monitoring system. As a result of the on-
going water quality monitoring, the Section may require additional ground water
monitoring wells for assessment and, if necessary, corrective action.
Please note, that this closure shall become effective upon written
notification by the owner/operator that the facility shall be maintained in
compliance with the post closure conditions specified in this letter. Rule .0510 also
states that Nyhen a disposal unit is closed, the permit to operate that unit is
terminaterd and any future disposal operations will require approval by the Section.

MANAGEMENT OF LANDFILL GAS: The owner and/or
operator shall take the measures necessary to ensure that the closed
site shall continue to meet the design standards for landfill gas found
in Rule .0503(2)(a).
2. MANAGEMENT OF SURFACE WATER: The owner and/or
operator shall take the measures necessary to ensure that the closed
site shall meet the requirements of Rule .0503(2)(c). In addition, the
landfill unit shall be maintained such that surface water runoff
occurs in a controlled manner, and surface water shall not be
impounded over waste.
3. AIR QUALITY: The owner/operator shall ensure that landfill units
do not violate any applicable requirements developed under a State
Implementation Plan approved or promulgated by the U.S. EPA
Administrator pursuant to Section 110 of the Clean Air Act, as
amended.
4. FINAL COVER SYSTEM: The integrity and effectiveness of the
final cover system and any permanent erosion control devices must
be maintained. This could include making repairs to the cover as
necessary to correct the effects of settlement, subsidence, erosion, or
other events.
5. PROPOSED USES: The owner/operator shall submit a proposal
for the Section's review and approval addressing post closures uses
of the facility. Proposed post closure uses shall not violate any post
closure conditions found in this letter. In particular, plans for post
closure uses shall avoid possibilities for the entrapment of methane
gas. Routine landfill gas monitoring within structures and at the
facility boundary may not be sufficient to detect potentially
dangerous situations.
6. ONGOING SOLID WASTE MANAGEMENT ACTIVITIES:
Cpnfinuing solid waste management activities, if any, shall not
violate any post closure conditions found in this letter, and must
meet any other applicable requirements.

7. RECORDATION: The owner/operator shall ensure that the
recordation requirements for land disposal sites found in Rule .0204
are met.
WATER QUALITY MONITORING AND REPORTING
REQUIREMENTS:
a. Groundwater quality at this facility is subject to the
"Classification and Water Quality Standards Applicable to
the Ground waters of North Carolina," 15A NCAC 2L. This
includes, but is not limited to, the provisions for detection
monitoring, assessment, and corrective action.
b. The permittee shall sample the detection monitoring wells
and surface water sampling location(s) at a minimum on a
semi-annual basis.
Water quality detection monitoring shall continue for a
minimum of five years from the date of the Section's receipt
of the owner/operator's notification that the facility will be
maintained in compliance with the post -closure conditions
specified in this letter. After five years the Section will
determine if further monitoring is to be required.
d. Sampling equipment and methods shall conform to
specifications in Attachment 1, "North Carolina Water
Quality Monitoring Guidance Document for Solid Waste
Facilities." The sampling parameters and methods shall be
those found in Attachment 2, "Sampling and Analysis
Requirements for Construction -and Demolition Landfills and
Closed Sanitary Landfills", or an alternate list of sampling
parameters as approved by the Solid Waste Section.
e. The permittee shall maintain a record of all monitoring
events and analytical data. Reports of the sampling events
and analytical data shall be submitted to the Section in a
timely manner.

Dear Ms. DeRosa:
In response to the complaint received on May 27, 1999 regarding the above
referenced landfill, I authorized an immediate inspection of that facility by a
North Carolina registered professional engineer. That inspection was
conducted on May 29, 1999 by Mr. Patrick J. Flood, P.E-, Manager, Waste
Services Group of Earth Tech in Greenville, SC.
A copy of Mr. Flood's June 1, 1999 report of his findings is attached for your
review, as is a copy of my May 28, 1999 letter requesting his services. I had
previously inspected the landfill on March 23, 1999 so l am not surprised
when Mr. Flood reports nothing out of order with the current conditions. l will
forward a copy of the photographs taken during his inspection as soon as
they are reproduced.
Champion understands and appreciates the need for the DHENR to respond
appropriately to citizen's complaints. The attached information is offered only
to more thoroughly document the current conditions of the landfill_ 1 look
forward to speaking with you farther regarding this situation and trust that you
will keep me informed of DHENR's intended course of action.
As 1 mentioned in our conversation earlier today, I will be out of the office on
Wednesday and Thursday, June 2 and 3- 1 will be back in my office on
Friday, June 4-

As requested In our conversation on May 28, 1999, and confirmed by your letter
that same day, I have performed an examination of Landfill No. 1 at Champion ff6a z 3 4.3 a 9
InternadmW Corporation's Canton, North C0xclina. Mill. This examination took
place on May 29, 1999, presented brlow is it summary of that =aam n n.
L=M1 12pography
Lw d= No. I contains two major surfaces. The upper surfer is flat and level.
The landW is located belxind a series of residences and extenda to the edge of the
slope. The upper surface is currently being used as a hayfield. The majority of the
residences exist at the southwest cud of the rapper surface, with one residance
looted south of Landfill No. 1. Prom the upper surface, Landfill No.1 slopes cast
and northeast down toward the Pigeon River. An access rued exists at the base of
ttac slope. A spur of this access road leads down to the edge of the Pigeon River.
Site Examination
The landfill examination took place in three major parts. First, the upper surface of
dw landfill was examined for the presence of visible waste mmerial. As noted
above, this surface of the landfill is currently being used as a Hayfield. At the time
of my site visit, the hay had been newly cut, but not yet raked into windrows,
affording an excellent opportunity to view the condition of the landfill surfma. At
the time of my site visit, the landfill surface cover appaered to be Intact. No visible
waste, holes, or rutting In the surface was apparent.

The second phase of the =aminatiou consisted of walking along the slope benches
on the river side of the landfill to determine if visible waste existed. The vegetation
is much better established than that last time we visited the site. The thick
vegetation made walking the length of the first bench from the top very difficult. Y
had intended to walk mwross the landfill on the first bench and to walls back to the
road along the second bench. However, the vegetation on the second bench was too
thick to navigate safely. The Brat beach provided numerous areas to examine the
slope and to take photogWbs.
The fetal phase of the examination consisted of walking the road se the base of the
laradfll slope and observing the condition of'the repaixs and looking for areas of
exposed waste. In addition, I walked clown the lower toad (toward the river) to
check for visible waste or signs of slope distress.
Sutmnary of Findings
Bawd oa my examinatloru of the bite, i did not find any evidence of the existence of
visible waste mawr➢al at the upper surface of the landfill. Due the hay field being
freshly mown, wawa rnawriol would steely have been readily observed. This area
of the landM was not noticeably different from whoa we examined the site on
March 23, 1999,
The landfill slope, too, was not noticeably different from when we examined the
site in March. The vegetation has grown considerably tlti ; thin areas of
Vegetatiou were very rare. The repaired eras are still holding up well and do not
appear to have degraded since we were there in March.
No visible waste was noted, with the possible exception of small amunt of
material that may be ash near the bottom of the slope (see photograph). It is
possible that this mat eW is topsoil; it was difficalt to positively identify the
wAtm ial in questioa. This material was noted in two small (approximately four
square inches each) areas near the edge of the retaining wall where the vegetation
was thin.
Attached to this letter is a photogmphk log describing the pictures taken of the site
as well as a set of photographs whir-h provide an overall view of the condition of
the landfill. As caul be sue, tho upper surface of the landfill appears to be in
excellent condition; the landfill slope also appears to be in excellent condition. The
landfill appears to be in the same condition as when wo visited the site in Match,
the only ohange berms the improvement in the vegetation cover.
