Every effort wi=be made to satisfy the terms of our agreement of October 1, 1982. The water should be completely drained by November 30, 1982 and the backfill is expected to be complete by January 31, 1983 barring unforseen inclimate weather. We were aware that a potential problem existed at the landfill. There is a large body of impounded surface water at the landfill. We were already requiring that this situation be corrected and we were working with Mary Lee Ransmeier of Champion to eliminate this impoundment by late summer or early fall of this year. In the mean time, Champion is planning some temporary measure to control the mosquitoe problem. At the suggestion of Medical Entomologist Nolan Newton with the Division of Health Services, Vector Control Branch, they have instructed Southern Pest Control, which contracts with Champion, to increase the volume of insecticide applied to the area by using a fogger instead of the presently used sprayer. The fogger is expected to be available within a very few days and will be used every day for 2-3 weeks and once weekly thereafter. If this proves ineffective Champion plans to use a stronger chemical in the fogger. I contacted the Teagues and informed them of the above. Levine, M.D., M.P.H. STATE HEALTH DIRKTOR October 5, 1982 On June 15, 1982 and September 22, 1982 I inspected the Champion Landfill (Permit #44-02) in Canton, NC. This letter is to notify you that the following violation of the N. C. Solid Waste Management Rules was recorded on these two consecutive inspections: Failure to prevent surface water impoundment (DHS Rule .115 /12) As you agreed to in our conversation on October 1, 1982, we are requiring that this water be removed by November 30, 1982 and the area backfilled by January 31, 1983. Any violations of the Solid Waste Management Rules are subject to administrative penalties or injunctive action pursuant to General Statute 130-166 21E.
