Rezoning Approval(1309,1315 & 1444 Mooresville Road)
Mr. Maher:
At its regularly scheduled meeting held on May 2, 2018, the City of Kannapolis Planning and
Zoning Commission approved your request to rezone properties located at 1309, 1315 and 1444
Mooresville Road (specifically identified as Cabarms County PIN(s) 5613-07-0027, 5603-97-
9050, and 5603-96-6758) from a zoning district designation of RV (Residential Village) to a
zoning district designation of O-I (Office Institutional) to allow for development of a real estate
office.
The decision of the Planning and Zoning Commission may be appealed within fifteen (15) days to
the City Council. Any appeal must be filed with the Planning Department.

Please send documentation showing that the parcel is zoned as commercial. A residential restriction would
include the following `Be advised that as soil contamination may exceed the residential MSCCs, the area of the
property containing the soil contamination is suitable only for restricted residential use ("residential" being
inclusive of, but not limited to, private houses, apartment complexes, schools, nursing homes, parks, recreation
areas and day care centers), as stipulated in the Notice of Residual Petroleum. Groundwater from the site is
prohibited from use as a water supply. Water supply wells of any kind shall not be installed or operated on the
site." The commercial realty office would be allowed since it would not violate the residential restrictions. Any
contaminated soil that is disturbed during construction of the office extension would need to be disposed of
properly.

Hi Trudy,
I just spoke with Alan. He wasn't aware that my property was zoned commercial. When I purchased it the
zoning was residential and I hs it refined. A number of years ago when the Mooresville Road widening project
was approved the city of Kannapolis established a new comprehensive plan which identifies that stretch of
Mooresville Road as commercial use. (I can send you documentation if that helps).
Additionally my building expansion plans were approved as commercial space (Office/Institutional). This
property will never go back to residential use.
Knowing this do we still need to perform the risk based sampling?
