As of today, the SWS is still waiting the submittal of the Operations Plan of this proposed LCIDLF facility. The SWS received the permit fee of 50.00 dollars on July 21, 2020 and the following permit application documents on July 10 & 17, 2020: - Completed Permit Application Form and New Facility Data Sheet. - Property deeds (DB 336 P526-527 & DB 1243, p972-974) of the proposed landfill facility. - Drawings (CS, C1, D1 & D2) titled LCID Facility Plan with Sediment and Erosion Control Plan. - Drawings (CS, C-1, C-2, C-3, D-1, D-2, D-3) titled A& H Mine 401 Sand Company LLC Mining Plan. - LCID Report (total 8 pages) including narratives of LCIDLF siting requirements, groundwater table investigation report, zoning approval letter (dated 05/05/2020)site map (USGS Quad Map), aerial photo of the site location (LS). - A&H Mine, Sedimentation & Erosion Control Calculations (34 pages). - Existing LCID Notification application (N0396 LCIDN47L-N-D Landfill) - 6 pages. - LCID capacity amount (1 page). - Ming Permit approval letter (dated 05/28/2014) & cover page of the mining permit 47-16. Per NCGS 130A-295.8(e), the SWS shall determine whether an application for a permit for a solid waste management facility that is subject to a fee under this section is complete within 90 days after the SWS receives the application for the permit. A determination of completeness means that the application includes all required components but does not mean that the required components provide all of the information that is required for the SWS to make a decision on the application. The SWS, hereby, determines the received permit application is an "INCOMPLETED" one because the rule-required Operation Plan is NOT included in the received permit application package. Please submit the requested Operation Plan for the proposed LCIDLF. If you have any question of the permit application or permit processes, please contact me. The major change of the draft rule is including LCIDLF closure and post-closure requirements (.0567). It may or may not be applicable for this permit application because the rule review and approval are outside the DEQ's reach and governed by the committees who directly report to NC General Assembly. However, should the draft rule passes, the permit holder will be requested to modify the permit application and the new permit will be issued after the new application is approved. > > I don't expect to send you any more info until the complete permit application is received and reviewed. > > [cid:image005.png@01D656BE.CDE8CF50] > > From: Chao, Ming-tai > Sent: Friday, July 10, 2020 12:33 PM > To: sean@rwkpa.com > Cc: lisacjl123@aol.com; cpiratzky@rwkpa.com; Stanley, Sherri <Sherri.Stanley@ncdenr.gov>; Powell, David C <David.Powell@ncdenr.gov>; Johnson, Mary H (mary.johnson@ncdenr.gov) <mary.johnson@ncdenr.gov> > Subject: RE: New LCIDLF permit application, Hoke County > > Dear Mr. McLean: > > After a quick review, the SWS can't locate the Operations Plan in the permit application; the plan is required by Rules 15A NCAC 13B. 0564-.0566. Please send an electronic copy of the NC mining permit and approved permit application associated the approved mining activities at this facility. The SWS record also show there is a LCID Notification Site (N0396) at the same address as this new proposed LCIDLF. If this is the correct info, please confirm it and forward me the electronic copy of the site (N0396) application document. To do so, many LCIDLF siting requirements (Rules 15A NCAC 13B .0564 & .0565) may have been approved by the same state agencies previously, so the paper works & efforts of permit review process can be significantly reduced for this landfill application. > > Additionally, please fill out the site application forms (see attachments) and return the completed form to my attention; so that the SWS accountant can send in the permit fee invoice to the right person. > > Pursuant to NCGS 130A-295.2 & 295.3, the SWS will conduct facility compliance history review (CHR) later; the CHR forms will send to the permit applicant (based on the info on the application form). > > Please feel free to contact me via e-mail message, if you have any questions of the permit review processes.
