Solid Waste Management Facility Permit No. 5 602T -TRANSFER- 1995 (FID 1319432) dated May 1, 2019, includes Permit for Closure 5601-MSWLF-1980 McDowell County Landfill. Additionally, Closure letter dated December 21, 1995, (Doc. ID 19102) issued to facility with Post -Closure Conditions. PURPOSE OF SITE VISIT: Comprehensive Facility Inspection. STATUS OF PAST NOTED VIOLATIONS: 1. 15A NCAC 13B .0510(c) RESOLVED. During this inspection, established vegetation was observed on the closed MSWLF Category I and II landfill caps. 2. 15A NCAC 13B .0503(2)(a) CORRECTIVE ACTIONS ONGOING. As required, since the previous inspection, the facility has conducted investigation and remediation activities to demonstrate that the closed site can meet the design standards for landfill gas (LFG) in 15A NCAC 13B .0503(2)(a). In February 2018 the facility submitted a Landfill Gas Monitoring Plan (FID 1200986) to the Section. In June 2018 the facility submitted a Revised Landfill Gas Monitoring Plan (FID 1234046), which was subsequently approved by the Section the same month. The facility began quarterly LFG monitoring at the site on September 6, 2018, and also submitted a Gas Probe Installation Report (FID 1237698), dated September 7, 2018, to the Section. On April 18, 2019, the facility submitted a LFG Remediation Plan (FID 1319791), which was approved by the Section on Page 1 of 4 FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management NORTH CAROLINA pepaNnen�a�EnrimnmmWl puality Solid Waste Section April 22, 2019. The facility submitted a LFG Remediation Plan - Phase 1 Report & Update (FID 1366799), dated July 9, 2019, which was approved by the Section on July 16, 2019. Additionally, the facility submitted a Gas Vent and Gas Probe Installation Report (FID 1377138), dated November 15, 2019, to the Section. Also, as required, the facility has continued to submit quarterly LFG monitoring reports to the Section. The First Quarterly LFG Monitoring Report of 2020 (FID 1428009), dated January 20, 2020, and the Second Quarterly LFG Monitoring Report of 2020 (FID 1427994), dated June 16, 2020, were submitted to the Section in a timely manner. The Section appreciates McDowell County's efforts to monitor for LFG at the closed MSWLF. OBSERVED VIOLATIONS: None. The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. ADDITIONAL COMMENTS Note: Please refer to the previous Facility Compliance Inspection Report, dated February 17, 2017, for a site history and background on this facility. 1. On -site July 28, 2020, to conduct comprehensive facility inspection of the closed MSWLF. 2. Post inspection, additional facility research conducted which concluded on August 5, 2020. 3. Access to the site is located off US NC-226 Highway and is controlled by a lockable gate. 4. Access roads at the site were maintained. 5. Edge -of -waste (EOW) markers were observed around the closed Category I and Category II MSWLF's and appeared to be maintained. Since the previous facility inspection, further delineation of the EOW was conducted (during LFG investigation/remediation efforts) for the closed Category I MSWLF, especially along the southeastern edge. Continue to maintain EOW markers at the facility as necessary. 6. No apparent leachate breakouts or seeps were observed during this inspection. 7. Semi-annual groundwater monitoring reports for the facility dated June 16, 2020 (for Spring 2020 sampling event) and December 2, 2019 (for Fall 2019 sampling event) were available for review. Additionally, since the previous inspection, the facility submitted a Groundwater Assessment Plan (FID 1234116), dated June 29, 2018, to the Section, which was approved on July 9, 2018. In accordance with the Groundwater Assessment Plan, a Groundwater Assessment Report and Alternate Source Demonstration Report (FID 1284991), dated February 8, 2019, was submitted to the Section. Upon Section review, a Revised Groundwater Assessment Plan (FID 1336805), dated July 15, 2019, was submitted and approved on July 16, 2019. The facility also submitted an Addendum to Groundwater Assessment Report (FID 1379893), dated December 2, 2019, to the Section. As required, continue to monitor all groundwater sampling locations at the facility and submit reports to the Section in a timely manner. 8. The groundwater monitoring network for the closed MSWLF is currently comprised of six groundwater monitoring wells (MW-1, MW-2, MW-3, MW-4, NES-1, and NES-2). Since the previous inspection, groundwater monitoring wells NES-1 and NES-2 were installed at the facility. During this inspection, groundwater monitoring wells MW-1, MW-2, MW-3, NES-1, and NES-2 at the facility were observed. Additionally, continue to maintain access for all groundwater monitoring locations at the facility. 9. Please refer to the Status of Past Noted Violations #2 for information regarding LFG monitoring reports for the facility. 10. The LFG monitoring network for the closed MSWLF is currently comprised of eleven LFG monitoring wells (GP- 1, GP-2, GP-3A, GP-4, GP-5, GP-6, GP-7, GP-8, GP-9, GP-10, and GP-11) around the perimeter of the landfill, eleven structures/buildings (located on and off -site), and seven passive LFG vents (GV-1, GV-2, GV-3, and GV-4 on the Category I landfill and MDW-1, MDW-2, and MDW-3 on the Category II landfill). During this inspection, LFG monitoring wells GP-1 (photo #1), GP-2, GP-3A, GP-7, GP-9, GP-10, and GP-11, as well as LFG vents GV-1, GV-2, GV-3, GV-4 (photo #2), MDW-1, MDW-2, and MDW-3 were observed. Continue to maintain access for all LFG monitoring locations at the facility. 1. LFG Monitoring Well #GP-1. (Note: vent recently installed at the closed Category I MSWLF.) 11. As referenced in the Status of Past Noted Violations #1, during this inspection ground cover appeared to be well established on the slopes and cap of the closed MSWLF (photos #3 & #4). Continue to maintain ground cover on the areas where passive LFG vents were recently installed on the Category I MSWLF. After mowing events occur, continue to ensure the landfill cap and side slopes are inspected for subsidence, cracking, signs of erosion or damage, and that repairs are conducted as necessary.
