Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. ADDITIONAL COMMENTS 1. All photos were taken by Lee Hill on July 24, 2020. 2. The facility is owned by Haywood County and operated by Santek Environmental of North Carolina, LLC. 3. The service area for the facility is Avery County, Buncombe County, Burke County, Cherokee County, Clay County, Graham County, Henderson County, Jackson County, Macon County, Madison County, McDowell County, Mitchell County, Polk County, Rutherford County, Swain County, Transylvania County, and Yancey County. 4. The facility is currently in the process of constructing the Phase 5 cell adjacent to Phase 4. Ouerational Insuection of the MSWLF Unit (4407-MSWLF-1993) 5. The facility is currently filling in Phase 4. 6. The facility received more than one inch of rain the evening prior to the inspection. 7. The working face appeared to be compact, of manageable size and no unapproved material was observed. 8. The side slopes of Phases 3 and 4 had good soil cover and no exposed waste was noted. Slope drains had been installed to manage storm water from Phase 4. 9. A small amount of windblown material was observed in the storm water ditch located on the north side of Phase 4, but otherwise windblown litter was well managed. 10. A slope drain that was installed on the north side of Phase 4 had been undermined. Repair the slope drain to prevent cover soil from eroding. 11. The facility has repaired, seeded, and matted the side slope of Phase 3. 12. The leachate pond had adequate freeboard and no visible deficiencies were observed in the liner. Other Comments 13. The section received an odor and landfill gas complaint from a citizen in the neighboring community. Prior to the inspection, a brief canvasing of the neighborhood was conducted. At the conclusion of the inspection the surrounding neighborhood was toured again. No odor was detected during either investigation. 14. During the inspection, landfill gas odor was detected adjacent to the working face; however, the odor was confined within the facility boundaries. 15. The facility provided landfill gas monitoring data for the second quarter of 2020 and no exceedances were reported. It is recommended that facility staff monitor the area near the southern property boundary regularly for landfill gas odors.
