The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance
with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an
administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit,
or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to
enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any
such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.
ADDITIONAL COMMENTS:
1. The disposal site is situated on a 320-acre property which contains two residential dwellings, several
outbuildings, and a tree farm.

2. An initial meeting took place at the site on December 12, 2019 for the purpose of viewing the proposed LCID
area and discussing Mr. Helfrey's plans for a small LCID landfill to be used mainly for the purpose of disposing
of vegetative debris from the tree farm property. Mr. Helfrey stated that additional waste may be accepted from
outside customers as well. Requirements for the construction and operation of a notified LCID landfill were
also discussed in detail during this initial site visit.
3. On June 22, 2020, a pre -operations inspection revealed erosion and sedimentation that had resulted from heavy
rainstorms during the two -week period preceding the inspection. The perimeter drainage swale system had been
damaged, and water was observed ponding in the disposal area. Mr. Nooe agreed to ensure that repairs were
made to the erosion control system and to schedule another pre -operations inspection when repairs were
complete.
4. On July 27, 2020, a follow-up inspection was conducted to ensure that the landfill was ready to begin
operations.
5. Permanent edge -of -waste markers in the form of metal stakes with white -painted tops had been installed as
required prior to the June 22, 2020 inspection. However, brush and weeds had been allowed to grow around the
edge of the disposal area, and, as a result, a number of the markers were obscured from view during the July 27,
2020 inspection. Please remove the vegetative growth obscuring the disposal boundary prior to beginning
landfill operations; and, ensure that all edge -of -waste markers are continually maintained so that they
remain visible along the entire perimeter of the landfill disposal area. This requirement serves to
demonstrate that the facility remains within the 2-acre size limit for a notified LCID landfill.
6. On July 27, 2020, perimeter drainage swales were observed to be in good condition. Matting had been installed
to reinforce the structure of the ditches, and the drainage system appeared to be functioning properly. No
ponding water was observed inside the landfill footprint or in surrounding areas onsite. Erosion control
measures appear to comply with 15A NCAC 13B .0566(6).
7. The access roadway leading to the landfill is of all-weather construction and was found to be in good condition.
8. A gravel pad had been installed on the south side of the access roadway at the approach to the landfill tipping
area. On June 22, 2020, the tipping area itself was observed to be inadequately defined and constructed to
enable trucks and equipment to maneuver safely when unloading and managing waste. Soil had been pushed up
to meet the gravel pad, but the soil had not been sufficiently compacted to provide a stable base for vehicles to
back in and dump their loads. A plastic drainage pipe could be seen beyond the mounded soil but had not been
properly installed to enable water to be conveyed as shown on the approved erosion control plans.
9. On July 27, 2020, the soil tipping area had been compacted and shaped to provide a stable area for trucks to
back in, unload, and leave the disposal area safely, and the drainage pipe had been properly installed to direct
surface water runoff from the tipping area.
10. Some brush and stumps were observed within the disposal area near the northeastern edge during both the June
22, 2020 and July 27, 2020 inspections. Mr. Nooe stated that this waste had been generated as a result of
constructing the landfill, and that no waste had been brought in from other areas of the property or from outside
customers. A portion of this vegetative waste appeared to have been partially compacted and partially covered
with soil.
• 15A NCAC 13B .0566(3) requires that waste be restricted to the smallest area feasible and
compacted as densely as practical into cells. Ensure that appropriate equipment is used to ensure
that waste is adequately compacted.
• 15A NCAC 13B .0566(4) requires that soil cover be applied to the landfill at least monthly, or
when the active area reaches one acre in size. Ensure that all waste in the landfill is covered with
clean soil as required. It is recommended that a cover log is maintained at the facility that
includes the dates cover was applied so that compliance can be effectively demonstrated.
11. Mr. Nooe stated that the fill sequence for the landfill would proceed from the northeast to the southwest, and
that the access roadway will be extended through the middle of the disposal area as filling progresses.
12. A sign had been posted at the roadway entrance to the property indicating the facility name and contact
information, as required by 15A NCAC 13B .0566(16).
13. A locking gate is located on the access roadway a short distance from Ellisboro Road to prevent unauthorized
access to the site, as required by 15A NCAC 13B .0566(8).

14. An attendant must be on duty at the landfill during operating hours to ensure compliance with required
operational procedures and to prevent acceptance of any unauthorized waste, as required by 15A NCAC 13B
.0566(8).
