N.C.G.S. 130A-291.1(h1) A permitted septage firm shall notify the Department with 10 days of placing a pumper vehicle in service that was not previously included in a permit issued to the firm and shall make the pumper vehicle available for inspection by the Department. A septage management firm is not prohibited from use of a pumper vehicle that meets the requirements of the rules adopted by the Commission prior to inspection by the Department. During this inspection it was noted that three new vehicles had been put in service without notifying this office. In the future Donathon Pumping Service Inc. shall inform this office within 10 days of any new or replacement vehicles so that an inspection may be scheduled. 2. 15A NCAC 13B .0835(b) All permitted septage management firms shall display lettering on each side of every pumper vehicle operated by the firm. The lettering shall include the firm name, town name, phone number, and septage management firm permit number as shown on the firm application. All lettering required by this Rule on the pumper vehicle shall be no less than three inches in height and legible, distinguishable from the background and no obstructed from view. Inspected vehicle tag#JR2159, VIN correct per the firm application – the town name (Cameron) was missing from the passenger side of the vehicle). Display the town name at no less than three inches in height & send a photo to this office of the corrective action. Tag# JZ5568, VIN 1HTSLAAM91H359330, 1600 gallons Tag#EZ3635, VIN 54DC4W1B5FS804887, 700 gallons Tag#HW8839, VIN JALC4B16357017601, 500 gallons The tanks on these three vehicles appeared structurally sound & securely attached. Outlet covers were on and no drips/leaks were noted. The lettering was correct (per the information on the firm application) on both sides of these three vehicles. 2. Inspected the following vehicles listed on the last firm application. Tag#YA134147, VIN correct per the application. This vehicle is in compliance at this time. Tag#YA152982, VIN correct per the application. This vehicle had a different phone number displayed (774- 1804) which Mr. Donathon added to the firm application. Tag#YA141678, VIN correct per the application. This vehicle also had the different phone number. Tag#JR2159, VIN correct per the application. This vehicle also had the different phone number & a lettering violation noted on the front page of this report. Tag#FB1180, VIN correct per the application. Some of the decals in the phone number were damaged. The tanks on these five vehicles appeared structurally sound & securely attached. Outlet covers were on and no drips/leaks were noted. The lettering was correct on both sides of these vehicles except for the missing town name on Tag#JR2159 and the phone number issue. Future firm applications should list both phone numbers if that is what is on the vehicles. Noted various decals on different vehicles that were damaged and will need replaced in the future. 3. Two vehicles listed on the last firm application are no longer in service. Tag#EB5725 and Tag#JF6315 4. Reviewed the truck pumping logs. The example truck log is being used and it appears that the required information is being maintained except for some discrepancies with the porta john trucks. Information for each daily route for each truck should be listed separately (currently it is shown as one line with a total for all trucks each day). Also it is not shown on the log when some of the smaller trucks unload into the larger trucks for the waste to be taken to the WWTP. Mr. Donathon stated that he would make changes to the record keeping to correct these issues regarding the porta john routes. 5. Discussed obtaining a septage treatment facility permit. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.
