Dear Mr. Hare,
On August 7, 2019, Davy Conners and Ethan Caldwell, representing the State of North Carolina,
Division of Waste Management Solid Waste Section (Section), inspected the above referenced
facility for compliance with North Carolina solid waste statutes and rules. The facility was found
in violation of the 15A North Carolina Administrative Code 13B .0106 (a and b), and .0203 (d),
and Permit Condition Attachment 4, Part I, 4(g). As a result, a Notice of Violation (NOV) letter
was issued on August 28, 2019.
To achieve compliance, the facility was required to cease sending tire char to sites not permitted
to receive waste, take measures to prevent tire char from contaminating surface water,
groundwater, and soil, and submit a sampling plan and conduct soil and water sampling in
accordance with the sampling requirements noted in the NOV.
On December 16, 2019, PRTI, Inc. gathered soil samples for lab analysis by Con -Test Analytical
Laboratory, in accordance with the sampling requirements in the NOV. On February 5, 2020,
PRTI, Inc. sent the Section an email that included the soil sample analytical results. The results
met the regulatory standards.
On January 15, 2020, PRTI, Inc. gathered water samples for lab analysis by Con -Test Analytical
Laboratory, in accordance with the sampling requirements in the NOV. On January 31, 2020,
PRTI, Inc. sent the Section an email that included the water sample analytical results. The results

exceeded the regulatory standard for zinc. On May 20, 2020, PRTI, Inc. gathered water samples
for lab analysis by Con -Test Analytical Laboratory, in accordance with the sampling requirements
in the NOV. On June 11, 2020, PRTI, Inc. sent the Section an email with an update on the
corrective actions at the site and the water sample analytical results. The results still showed an
exceedance of the regulatory standard for zinc; however, it was much lower than the January 15,
2020 sampling event. The Division of Energy, Mineral, and Land Resources has been notified of
these exceedances.
In March 2020, when the state's governor instituted a stay-at-home order in response to COVID-
19, this facility shutdown and has not reopened since.
On December 6, 2019 and June 30, 2020, the Section conducted follow-up inspections of the
facility. Details of the findings of the inspection can be found in the 12/6/19 inspection report
and 6/30/2020 inspection report.
Based on the sampling events submitted and findings during the above referenced inspections,
the requirements of the August 7, 2019, Notice of Violation have been satisfied and the violations
have been resolved.
However, due to the water sample's zinc exceedances and the fact that the facility was not
operating during the most recent sampling event, the Section requests an additional water
sample be taken between 30 to 60 days after the site renews operations. This sample should
test for zinc and be done in accordance with the sampling requirements noted in the NOV. Please
submit results to the Section within 30 days of sampling event.
