Ben Machon, PRTI, Inc. STATUS OF PERMIT: Permit to Operate was issued on March 20, 2020 and will expire on March 20, 2025. PURPOSE OF SITE VISIT: Follow up inspection to the August 7, 2019 compliance inspection. STATUS OF PAST NOTED VIOLATIONS: A. RESOLVED: 15A NCAC 13B .0106 GENERATOR OF SOLID WASTE (a) A solid waste generator shall be responsible for the satisfactory storage, collection and disposal of solid waste. And, (b) The solid waste generator shall ensure that his waste is disposed of at a site or facility which is permitted to receive the waste. RESOLVED, WITH ADDITIONAL SAMPLING REQUIRED: 15A NCAC 13B .0203 PERMIT APPROVAL OR DENIAL (d) By receiving solid waste at a permitted facility, the permittee(s) shall be considered to have accepted the conditions of the permit and shall comply with the conditions of the permit. PRTI, Inc.has excavated all tire char that was observed migrating offsite during the August 7, 2019 inspection, including that which was in the forested area and the drainage ditches. Control measures, such as additional sediment basins, booms, berms, gravel, and regrading the site have been implemented which appears to be sufficient at preventing contamination. Soil samples taken from the site were within the standards. Water samples taken from the site had zinc levels higher than the standard, but lower than in previous sampling events. The Solid Waste Section has referred this issue to Division of Energy, Mineral, and Land Resources. Because the latest water sampling event did not meet the standard and was taken while the site was not in operation due to COVID-19, the Section requests an additional water sample be taken between 30 to 60 days after the site renews operations. This sample should test for zinc and be done in accordance with the sampling requirements noted in the August 7, 2019 Notice of Violation. Please submit results to the Section within 30 days of sampling event. STATUS OF PAST NOTED COMPLIANCE ISSUES: A. RESOLVED: During the August 7, 2019 inspection, tire char was found on the ground throughout the facility but was thickest around/near the grinder. The grinding operation was not under cover. During the June 30, 2020 inspection, the amount of tire char on the ground was greatly reduce. PRTI, Inc. has implemented management practices to better contain and clean up the tire char such as grinding under cover, covering the steel post -grinding, sweeping the grounds on a regular basis, and creating berms and other containment structures. B. RESOLVED: 15A NCAC 13B .1110 SCRAP TIRE PROCESSING FACILITIES (a)... At least 75% of both the scrap tires and processed tires that are delivered to or maintained on the site of the scrap tire processing facility site shall be processed and removed for recycling or disposal at a permitted solid waste management facility within one year of their receipt. AND, THE PERMIT TO OPERATE ATTACHMENT 4, PART I, NUMBER 2 The scrap tire processing facility is permitted to collect, store, process and maintain on site, not more than 13,000 tires or the equivalent in shredded tire or by-products. The stockpile of supersacks full of tire char, observed in the August 7, 2019 inspection, have been removed from the site and disposed of at Sampson County Landfill. C. RESOLVED: During the August 7, 2019 inspection, one of the scrape tire storage bays had some tires and rubber outside of the covered area. During the June 30, 2020 inspection all tires and rubber either had been removed or were being stored under cover. The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. Sediment basins, berms and ditches have been added to help retain the tire char and sediment. They appear to be working, as no tire char was observed leaving the site and the soil was a natural color. Continue to maintain these basins by periodically mucking them out. As operation are renewed, ensure tire char does not begin to leave the site. 2. There are several areas that require vegetation to prevent excessive erosion and sediment from leaving the site. Mr. Hare and Mr. Machon are aware of this issue and will be seeding as soon as weather permits. 3. The site has been shut down due to COVID-19 since mid -March. Please let me know when operations begin again. 4. Due to the shutdown, there are currently 7 trucks containing a total of approximately 7,000 tires onsite. The facility is restricted to collecting and storing less than 13,000 scrap tires at any time in accordance with the Financial Responsibility requirements of 15A NCAC 13B .I 111.
