PURPOSE OF SITE VISIT: Complaint. On 07-13-2020, John Farnell received a complaint about a storage tank at 5779 Manley Smith Road Nakina, North Carolina, possibly holding septage and insects attracted to the waste. STATUS OF PAST NOTED VIOLATIONS: None OBSERVED VIOLATIONS:

15A NCAC 13B .0837 (a) states: “No person shall establish, or allow to be established upon any real property owned, operated, leased, or controlled by that person, a septage detention and treatment facility, unless a permit has been obtained from the Division or the facility is operating in accordance
with a NPDES permit issued by the NC Division of Water Resources.”
You were in violation of 15A NCAC 13B .0837 (a) in that on July 14, 2020, a septage detention facility (tank) was established by Triple AAA Portable Toilets without a permit issued by the Division.

15A NCAC 13B .0837 (g) states: “Operation of a new septage detention or a new septage treatment facility shall not commence until the facility has been inspected by the Division and found to be consistent with the permit application.” You were in violation of 15A NCAC 13B .0837 (g) on July 14, 2020 because a permit application had not been submitted to the Division.

Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.

1 – On 07-13-2020, John Farnell received a complaint about a tank being used to store septage at 5779 Manley Smith Road Nakina, North Carolina. 2 – On 07-14-2020, Mr. Farnell met with Robert “Neal” Stocks at the above address to verify that the tank was on property. 3 – Pictures taken above show Mr. Stocks firm permit number NCS-01412 marked on the side of an approximate 8000 gallons tank. This violates rule 15A NCAC 13B .0837 (a) 4 – Mr. Stocks stated that he had used the tank in the past to store septage in times of bad weather, but at the time of
inspection the tank was empty. This violates rule 15A NCAC 13B .0837 (g) 5 – Mr. Stocks was informed by Mr. Farnell not to use the tank for septage storage until a proper permit could be used for its use.
