David Powell, Solid Waste Section met Scott Parks with Scotland County Solid waste to follow up on Notice of Violation corrective actions. 2. The access road should be repaired to all weather construction and maintained to allow proper access to the facility. Access road to top and side of NLCID was blocked with waste in 100-foot buffer area between waste next property line. No property line markers or EOW markers have been installed and no documentation showing property ownership being changed to Mr. Frizzell, have been provided. NLCID approved waste should be inside 2-acre footprint, covered and sloped properly. 3. The facility is to be operated for the disposal of land clearing waste, inert debris, untreated wood and yard waste . Unacceptable waste must be removed from the property and disposed of properly at a facility permitted to receive that waste type. Maintain all disposal tickets for review by Section staff. Industrial wood chip waste with comingled plastic still onsite, although it has been moved away from water and onto are a in which C and D waste was previously observed. It seems the C and D waste removed but unable to determine due to the industrial wood chips waste. Documentation/weight tickets have not been provided. 4. The total disposal area for the NLCID is to remain under two acres in size. Waste was still observed beyond the limits of the NLCID. All unacceptable waste should be removed and disposed of properly. The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 3 of 5 Acceptable waste must be placed within the limits of the NLCID. There is plastic and 5 gallon buckets in a few areas of the mine and on side slope of the NLCID. Remove and dispose properly. 5. The landfill still has not been covered and properly maintained. Trees, brush and other woody vegetation were observed growing on side slopes and exposed waste was observed. Remove the trees and woody vegetation and cover the waste in accordance to the rules. This has been mentioned before in previous inspection along with covering side slopes. 6. At the time of this inspection, the side slopes for the LF appeared to be less than 3:1. The landfill should be graded and sloped properly. After soil is added to cover exposed waste, measures must be taken to establish ground cover sufficient to restrain erosion. 7. All EOW Markers (white poles) marking the limits of the NLCID LF should be visible from one to the other to ensure that the limits of the LF do not go beyond two acres. Markers should be repaired and maintained. Any acceptable waste beyond the markers should be pushed back into the limits of the LF, covered and provided with ground cover. 8. The property lines must be clearly marked to ensure that the 100-foot buffer is being met and maintained. Based on Scotland County GIS photos, the waste on western side of the landfill may be on or close to the property line and possibly within the buffer on the eastern side of the landfill. 9. If this was not done, after mentioning in previous inspection, ensure that the notification is registered with the Scotland County Register of Deeds in your name in accordance with 15A NCAC 13B .0563 (2). 10. Contact DEMLR concerning a sedimentation and erosion control plan and/or a mining permit for the mining activities at this site. DWM informed DEMLR and provided contact information for DEMLR Representative Nick Mills to onsite representatives. 11. Wood and other vegetation was piled up onsite. Please note that burning of the waste, unless generated onsite, is prohibited and could be a violation of the North Carolina Air Quality Rules. Industrial Wood chip waste has been moved onto area where C and D was spread out. Need to see analytical results or product data sheet from manufacturer of Industrial wood chip waste to show its just clean wood Documentation provided of proper disposal for the trash and the C and D that was here. 13. At edge of water in back, looking towards NLCID LF. Overgrown, not covered and will need slope to be fixed 3:1. Waste outside of 2-acre foot print. Behind this view point, waste was in water but appears to be removed. FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 5 of 5 14. Corrective measures to bring this facility into compliance should be complete within 30 days’ receipt of this inspection report and Notice of Continuing Violations. Do not receive any additional waste at this site until all conditions for compliance have been met. A follow up compliance inspection will be conducted by Solid Waste Section Staff within the next 30 days. Failure to meet the conditions for compliance may result in further Compliance Actions.
