The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an
administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any
such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.

ADDITIONAL COMMENTS
1. Reason for inspection was to introduce new Division staff, routine inspection on Yard Waste(YW) area and take picture of debris site area for closure form.

2. Discussed beneficial fill while onsite. Can use mulch to assist with erosion control but not as fill. YW cannot be a “fill” material.

15A NCAC 13B .0562 BENEFICIAL FILL - A permit is not required for beneficial fill activity that meets all of the following conditions: (1) The fill material consists only of inert debris strictly limited to concrete, brick, concrete block, uncontaminated soil, rock, and gravel.
3. Debris site was not used in Hurricane Dorian, picture taken.

4. Yard waste area has approximately 2500 – 3000 cubic yards currently onsite. Remember can only have up to 6,000 cubic yards at any one time of material whether its processed yet or finished product. Simmons and Simmons grinds once a year and periodically hauls, as budget allows. Waste has gone to mine for slope stabilization and McGill Compositing in past, power plant burned for fuel and used at public works.

15A NCAC 13B .1402 (e)(6)(A) Small Type 1 facilities shall have an operations area less than two acres in size and shall be limited to no more than 6,000 cubic yards’ material onsite at any given time, including finished product.
5. Back two windrows were almost mixed together as one. Windrows need to be separated for fire control access. Fire control equipment should be nearby for emergencies. This has been here a while. Start working on
removal.
15A NCAC 13B .1406 (7)(a) Open burning of solid waste shall be prohibited. (b) Equipment shall be provided to control accidental fires and arrangements made with the local fire protection agency to provide fire -fighting services when needed. (c) Personnel training shall be provided to ensure that all employees are trained in site specific safety, remedial, and corrective action procedures.

6. Unacceptable waste was comingled in YW windrows some and also on yard. Staff onsite and staff picking up loads should screen trash and plastic from YW before hauling or loading and if necessary not accept the load if has unacceptable waste. Mr. Seals had staff clean up exposed unacceptable waste same day and text pictures that evening. Thank you.
15A NCAC 13B .1402 (e)(1) Type 1 facilities may receive yard and garden waste, silvicultural waste, and untreated and unpainted wood waste.
7. Sign at gated entrance is a piece of plywood with very minimal information and that has faded almost beyond recognition. A sign needs to be put up according to rules.
15A NCAC 13B .1406 (9) Sign Requirements. (a) Signs providing information on waste that may be received, dumping procedures, the hours during which the site is open for public use, and the permit number shall be posted at the site entrance. (b) Traffic signs and markers shall be provided to direct traffic to and from the discharge area. (c) Signs shall be posted stating that no hazardous waste, asbestos containing waste, or medical waste may be received at the site.

8. Facility has not been doing time and temperature for composting. While onsite David Powell took temperature of one area in a windrow which read 131 degrees F. It is stated on the renewal 5/2020 that the windrows would be turned once a year and time/temperatures taken. Getting a compost thermometer was discussed and Inspector even searched online and found a cheap one for ~20$ online. Mr. Seals indicated later that evening by cell phone text that unacceptable waste had been removed and a thermometer ordered. Pics of waste collected
text as well. Thank you and good job. Make a map and keep track of waste and time and temps for each. Three consecutive days at 131 degrees F or higher are necessary for giving waste out to public. Those records will be needed for next inspection with DWM.
15A NCAC 13B .1406 (11) Compost process at Type 1 and Type 2 facilities shall be maintained at or above 55 degrees Celsius (131 degrees F) for three days and aerated to maintain elevated temperatures.

9. A Yard Waste site is not permanent storage, but is a site for processing yard waste and trash in an area and manner according to Rule/NC Administrative Code and General Statute. Although this site has made considerable progress over the years, there are some corrective actions that need to be done. Yard Waste (Type 1 Compost facility) rules were sent to Mr. Seals for review and records. Currently there are two older windrows. If these do not meet time and temp records, then further sampling/testing methods may be required
if you plan to give it out to the public. Contact Donna Wilson with DWM at 919-707-8255/

Corrective actions – Start keeping time and temperature records for all waste. Construct a sign according to rule and install. Keep unacceptable waste from entering YW. Increase removal of processed YW. Keep windrows separate for fire control.
Two back windrows basically one big windrow. Be removing waste according to rule. If going to public must contact Donna Wilson on proper sampling before can be given to public.
