Ben and all,
The Section is willing to allow a one-time disposal of the comingled yard waste/trash material and storm debris in the
Nash County C&D landfill under the following conditions:
Due to the comingled yard trash, there is an increased risk of fire and the potential generation of landfill gas and
odors as the partially decomposed material is buried in the landfill. As such to abate those concerns, a minimum
of 6" of soil cover must be applied to the landfill at least every other day while the material is being
placed. Cover should be documented via the facility's cover log including date stamped photos, and shall be
made available to Section staff to review upon request.
This only applies to material currently stockpiled at the expired YW site and the remaining 2019 storm debris.
Approving this request is a band -aid to a larger problem of how the County manages this waste, that must be corrected
immediately. As has been documented in inspection reports and other correspondence over the last year, the County
has mismanaged this material since at least 2018, and has opposed many suggestions made by the Section to come into
compliance before now. However, the Section has chosen this decision in hopes of bringing this portion of the facility
operations into compliance rather than dragging this out for additional months. Further, the County needs to
immediately take the necessary actions to be positioned to handle debris for the forthcoming 2020 Hurricane
season. The management of this material to date should be seen as a disservice to the County's citizens and is resulting
in the elimination of valuable landfill capacity for material that doesn't need to be disposed. The rules and laws are
meant to be followed and the County took on that responsibility in applying for and obtaining a permit to operate this
facility. Choosing to not maintain that responsibility due to inconvenience or otherwise will not be tolerated moving
forward.

Afternoon,
We are now in the process of having a local contractor (Al Collie) install the intermediate cover for the
old C&DLF. The burned and composted material from across the haul road is being used to promote
grass growth. He is making good progress and anticipates seeding by the end of March. Collie is using a
large off road dump truck to move the old material to the C&D. Once the C&D cover has been finished
the dump truck would be ideal for removing the material from the temporary YW site and the storm
debris site. I believe with his equipment, the YW could be removed within 3 to 5 days. The storm
debris perhaps in the same length of time. This would satisfy most of the pending violations.
Transporting this material to the C&D would expedite the process and help with the standing water
problems in the operating cell. This material would probably be enough to fill to ground level.
My understanding is that we are awaiting a decision from the Section re disposing in the C&D. If this
could be expedited, I think we could have most of the violations corrected within 4 to 6 weeks.
We are ready to proceed.
