(FID): XXX NOTIFICATION OF FINAL PERMIT ACTION On ##, 2020, the Division of Waste Management (Division) issued Solid Waste Permit No. 6301-CDLF-1992, Permit to Construct – Cell 6 (FIDXXX), for the Moore County Construction and Demolition Debris Landfill (MSWLF). The Division determined that the proposed facility plan, the engineering plan, the operations plan, the construction quality assurance plan, the closure and post-closure plan, the water quality and landfill gas monitoring plan, and the documentation of public meetings and local government approval satisfied the requirements of the Solid Waste Management Rules (Rule) as codified in 15A NCAC 13B .0531 through .0547. DESCRIPTION Moore County requested a permit to construct a new Cell 6 immediately adjacent to the existing Moore County CDLF. The existing CDLF consists of a five (5)-phase waste disposal area encompassing 21.7 acres with a gross capacity of 1,870,000 cubic yards. According to the permit application, the construction of the Cell 6 of the landfill will include: • A 5.6-acre lateral expansion (Phase 6) which is not included in the original landfill disposal boundary but is within the landfill property boundary. This expansion will increase the landfill waste boundary to 27.3 acres. • Vertical expansions (Phases 7 & 8) over Phases 5 and 6 of the landfill. The expansions will not increase the 27.3-acre waste boundary but will increase the approved landfill final grade to approximately 475 feet above mean sea level. • The combined lateral and vertical expansions will increase the landfill gross capacity to 2,500,000 cubic yards. Per North Carolina General Statute 130A-294(a3)(1)b(ii) and (1)(c), the proposed lateral expansion and increase of 10 percent or more in the quantity of solid waste to be disposed of in an existing sanitary landfill requires a new permit. This permit that reflects the Moore County CDLF Landfill 6301-CDLF-1992 ##, 2020 FID XXX Page 2 of 3 request made by Moore County doesn’t change the landfill service area and characteristics of the landfill’s acceptable waste stream that have been approved in the previous permit. Moore County owns and operates this CDLF which is located at 456 Turning Leaf Way in Aberdeen, North Carolina. The CDLF is within the 215-acre landfill property which is also occupied by a closed MSWLF unit, an active MSW transfer station, and other non-disposal waste management units. The landfill service area is Moore County including all municipalities within the county. PERMIT STRUCTURE The permit is divided into two parts, the Permit Approval to Construct (PTC) and the Permit Approval to Operate (PTO). The PTC approves the construction of Cell 6 (including Phases 6, 7 and 8) of the Moore County CDLF. The PTO approves the waste disposal activities at existing Phases 1 through 5 (Cells 1 through 5) of the landfill. The permit consists of a list of approved documents and specific conditions for construction, operation and monitoring of the landfill unit. A copy of the final permit is attached. PUBLIC COMMENT PERIOD North Carolina Solid Waste Management Rules require that the public be given an opportunity to comment on a draft permit for a municipal solid waste management facility. This 45-day comment period began on May 27, 2020 and ended on July 12, 2020. The draft permit and related documents were available for review by appointment from 9 a.m. to 4 p.m., Monday-Friday, at the Division at 217 W. Jones Street in Raleigh, and could also be viewed online at: http://portal.ncdenr.org/web/wm/sw. All data submitted by the applicant is available as part of the administrative record. Persons who wished to provide comments have submitted comments in writing by 5 p.m., July 12, 2020, to the above-referenced Division address. All comments received within the 45-day period have been considered in making the final determinations regarding the permit. Comments on the typographical errors in the draft permit are properly corrected in the final permit. PUBLIC HEARING On June 15, 2020 at 6:00 PM the digital public hearing was held by the Division, Solid Waste Section. Interested parties submitted oral or written statements and data concerning the proposed new facility permit. One comment to support the construction and operation of the proposed new CDLF was received in the public hearing, and no response to the comment is required.
