Box 480053 Charlotte, NC 28269 PARTICIPANTS: Ryan Smith, Mecklenburg County, LUESA Kenneth Reeves, Reeves LCID Landfill STATUS OF PERMIT: Permit 60-S-LCID issued December 14, 2017 Permit Expiration December 14, 2022 PURPOSE OF SITE VISIT: Operational Inspection OBSERVED VIOLATIONS: STATUS OF PAST NOTED VIOLATIONS: 1. ISA NCAC 13B .0203(d) states `By receiving solid waste at a permitted facility, the permittee(s) shall be considered to have accepted the conditions of the permit and shall comply with the conditions of the permit." Attachment 2, Part 1, Condition 5 of the Permit to Operate states "This facility is permitted to receive land clearing waste, yard trash, untreated and unpainted wood, uncontaminated soil, and inert debris such as unpainted rock, brick, concrete, and concrete block." Page 1 of 4 FACILITY COMPLIANCE INSPECTION REPORT Mecldenburg County Land Use and Environmental Services Agency Solid Waste Division RESOLVED: During the previous inspection, corrugated plastic pipes, electrical cords and glass were observed in waste piles. Mr. Reeves, who was not present during the last inspection, stated that these wastes are diverted from landfilling to either be reused on site or disposed of in an onsite dumpster. 2. 15A NCAC 13B .0566(3) states: "Land Clearing and Inert Debris (LCID) landfills shall meet the following operational requirements: (3) Solid waste shall be restricted to the smallest area feasible and compacted as densely as possible into cells." CORRECTIVE MEASURES IN PROGRESS: The facility was cited in that waste was not restricted to the smallest area feasible. There is uncovered waste near the bottom of the southeast slope. During the inspection, work was being done to bury the debris and grade the slope. 3. 15A NCAC 13B .0566(4) states: "Land Clearing and Inert Debris (LCID) landfills shall meet the following operational requirements: (4) Adequate soil cover shall be applied monthly, or when the active area reaches one acre in size, whichever comes first." CORRECTIVE MEASURES IN PPROGRESS: The active working face appears to be under one acre. During the previous inspection, uncovered waste was observed on the southern slope. Waste was not observed at the top of the southern slope during this inspection, but some yard waste is still at the bottom. 4. 15A NCAC 13B .0566(5) states: "Land Clearing and Inert Debris (LCID) landfills shall meet the following operational requirements: (5) 120 calendar days after completion of any phase of disposal operations, or upon revocation of a permit, the disposal area shall be covered with a minimum of one foot of suitable soil cover sloped to allow surface water runoff in a controlled manner." CORRECTIVE MEASURES IN PROGRESS: Closed phases appeared to be adequately covered. The southern slope is currently being covered and regraded. Corrective measures will need to continue before this violation is resolved. 5. 15A NCAC 13B .0203(d) states `By receiving solid waste at a permitted facility, the permittee(s) shall be considered to have accepted the conditions of the permit and shall comply with the conditions of the permit." Attachment 3, Condition 14 (previously stated as Condition 7) of the Permit to Operate states "Excavation, grading and fill material side slopes must not exceed a ratio of three horizontal feet to one vertical foot (3:1)." CORRECTIVE MEASURES IN PROGRESS: The western slope appeared to exceed the 3:1 grade. Corrective measures will need to continue before this violation is resolved. Page 2 of 4 FACILITY COMPLIANCE INSPECTION REPORT Mecklenburg County Land Use and Environmental Services Agency Solid Waste Division Picture 1 (01/23/20) Currently Covering Southern Slope with Dirt and Regrading The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. ADDITIONAL COMMENTS: 1. No standing was observed on site. Stormwater was observed to be properly diverted into basin before entering Salome Church road. 2. An attendant was on duty at the scale house. Loads are screened by the equipment operator at the working face, and unpermitted waste rejected or removed. 3. A resident complaint was received last October regarding dust and dirt on Salome Church road. Excessive dirt was not observed on the road during a follow up site visit, but Mr. Reeves stated that he is looking to purchase a new water truck. Roads were dry and dusty during this inspection, and Salome Church road had excessive dirt. Mr. Reeves stated that he was having the roads washed 01/24/20. Entrance was secured by gate. Proper signage including permit number and emergency contacts was observed at the entrance. 5. No leachate discharge was observed during the inspection.
