Charlotte, NC 28214 PARTICIPANTS: Dustin Janes, Operations Manager, Waste Connections Josh Smaltz, Waste Connections Jim Lennon, Hilco, Operations Manager Jeff Kauffman, Hilco, Yard Supervisor Ryan Smith, Mecklenburg County, LUESA STATUS OF PERMIT: Change of Ownership occurred November 24, 2009 Permit to Operate issued November 24, 2009 10-year renewal issued October 27, 2014 Limited review scheduled November 24, 2019 Permit expires November 24, 2024 PURPOSE OF SITE VISIT: Operational Inspection Page 1 of 3 FACILITY COMPLIANCE INSPECTION REPORT Mecklenburg County Land Use and Environmental Services Agency Solid Waste Division STATUS OF PAST NOTED VIOLATIONS: 1. 15A NCAC 13B .0203(d) states `By receiving solid waste at a permitted facility, the permittee(s) shall be considered to have accepted the conditions of the permit and shall comply with the conditions of the permit." The facility was cited in violation of General Permit Condition 15(a) of the Permit to Operate for not effectively maintaining the concrete pad, staging areas, and building vicinity in a clean and sanitary condition at all times. CORRECTIVE MEASURES IN PROGRESS: Attention is required in areas around the trailer loading bays, and the outside wall adjacent to the trailer loading bays, behind the dumpster. To avoid further compliance actions, these areas need to be addressed immediately and kept free of grit and debris. Picture 1 (12/13/2019) Accumulating Waste Behind Dumpster OBSERVED VIOLATIONS: No new violations observed. The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. ADDITIONAL COMMENTS: 1. The new traffic pattern appears to still be effective. No traffic was observed on Jeff Adams drive. 2. Facility is secured by a barbed wire fence, along with a lockable entrance gate. 3. The inspection was performed during a rain event. Observed waste being unloaded onto covered tipping floor as required by permit condition 19 (c). No waste was observed in ponding water. 4. Observed secondary containment around leachate tanks in good condition and functional. 5. Leachate is collected and hauled to the Anson Landfill. Leachate undergoes a solidification process at the landfill and is then buried. 6. No unapproved waste was observed during the inspection. Rainfall appeared to be properly diverted into stormwater basin. It was stated that the basin is cleaned out annually. 8. Hay bales are placed around leachate drains to prevent larger debris from entering. This practice is acceptable if leachate does not enter stormwater basin. During the inspection, leachate was observed properly flowing into drains. 9. Drains in the tipping floor and staging area appeared to be functioning properly. It was suggested that one of the drains required attention, as it was beginning to clog. 10. No vector pests were observed during inspection. 11. Cleaning efforts have improved since previous visits. However, increased litter pickup is needed around the facility. 12. The areas behind push walls appear to be well maintained. It was stated they are periodically cleaned.
