STATUS OF PAST NOTED VIOLATIONS:
No violations noted on the previous inspection.

OBSERVED VIOLATIONS:
1) The “No Trespassing” sign was missing at the detention tank. Rule .0838(k) states “Access roads or
paths crossing or leading to the facility shall be posted with "NO TRESPASSING" signs.” Please place a
“No Trespassing” sign back at the detention tank as before.
The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.

ADDITIONAL COMMENTS

1) The “No Trespassing” sign was not present. Need to place a “No Trespassing” sign at the detention tank
as before.
2) Most of the tank was visible for inspection. Be sure to maintain an area around the tank so that the tank
walls can be inspected for any leaks.
3) It appears that the previous concrete tank has been replaced with a new concrete tank. See pictures
below of a picture of a tank on 06/27/2019 and 04/09/2020. If you add a tank or even replace a tank,
you are required to let us know. Rule .0838(s) states “Septage shall not be stored or treated at a new
septage treatment or detention facility until a representative of the Division has inspected the facility to
determine compliance with these Rules and consistency with the permit application and all permit
conditions.” It is important to let us know 1) so the new tank can be inspected before use and 2) in case
the permit would need to be modified. Please confirm by email that the concrete tank had been
replaced by another concrete tank of the same size. My email address is [e-mail].
4) No leaks of septage noticed from the tank. No signs of weakness noticed in the tank.
5) Access road to tank in good shape.
6) Septage transfers appear to be handled in a safe and sanitary manner. No septage spills noticed.
7) No objectionable odors or vector issues noticed today.
8) No change noticed that would affect setback distances.
