OBSERVED VIOLATIONS: NONE The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 2 of 2 ADDITIONAL COMMENTS 1) “No Trespassing” sign was at tank location as per 15A NCAC 13B .0838(k). 2) Access road in good shape as per 15A NCAC 13B .0838(b). 3) Tanks accessible for inspection. A five (5) feet area around the tanks was clear of debris and vegetation as per 15A NCAC 13B .0838(i). 4) The above ground 4,500 gallon steel tank that is currently permitted appears to be structurally sound as per 15A NCAC 13B .0838(c). No leaks noticed. 5) Septage appears to be transferred to and from the tank in a sanitary manner as per 15A 13B .0838(j). No septage spills noticed on the ground or on the 4,500 gallon steel tank that is currently permitted. 6) No odor or vector issues noticed. 7) Both the current permitted tank and the tank to be added met setback distances. 8) Marlon is in the process of adding a second above ground steel tank with an approximate capacity of 2,000 gallons. Tank was previously used as a tank on a pump truck for a permitted firm. Tank appears to be structurally sound in that no holes or cracks noticed that may allow for the discharge of septage as per 15A NCAC 13B .0838(c). Application needed for adding this tank. Cannot use tank until permit has been issued to include this tank. 0BTank on the left is currently permitted. Marlon is adding the 2,000 gallons tank to the right.
