PURPOSE OF SITE VISIT: Comprehensive Facility Compliance Inspection.
STATUS OF PAST NOTED VIOLATIONS: None
OBSERVED VIOLATIONS:
15A NCAC 13B .0566 OPERATIONAL REQ. FOR LAND CLEARING/INERT DEBRIS (LCID)
LANDFILLS: (4) Adequate soil cover shall be applied monthly, or when the active area reaches one acre in size, whichever occurs first. (16) A sign shall be posted at the facility entrance showing the contact name and number in case of an emergency and the permit number. The permit number requirement is not applicable for facilities not requiring an individual permit.

ADDITIONAL COMMENTS:
01 – Facility is secured by a locking gate.
02 – Facility has signage with required information, but need to replace emergency contact name and number. (Observed Violation) 03 – Edge of waste markers were down, need to reinstall. Some are in a portion of the 2 ac. tract that is not cleared yet.
Did not go to these markers.
04 – Roads are constructed of all-weather materials.
05 – Facility has a stockpile of cover material stored at the end of the LCID. 06 – Facility has decent cover. Remember ALL WASTE (Observed Violation, some older trees around the South side are well over days) must be covered at least monthly. Keep records.
07 – Concrete is being stored OUTSIDE of the LCID area. You must have it ground for use or move inside of LCID Notified area. LCID is Land Clearing and Inert Debris. Concrete is the Inert Debris, so it is being stored on an un-permitted area in which can be a NOTICE OF VIOLATION. This must be done in the next 30 days. A follow up inspection will be conducted to ensure compliance has been met. 08 – Facility has a staging area before the Notified area that has scrap metal and other items for recycle. 09 – The items should be brought in, source separated and keep in separate piles, not comingled. 10 – There were also scrap tires located in this area that needs to be removed. 11 – 75% of the items listed above (8-10) are recycle items and should be removed in a calendar year. See Attached document 130A.09 (C) 12 – Corrective actions are needed at this facility within 30 days, to ensure compliance and avoid a Notice of Violation. 13 – Facility also has a portable saw mill set up on the paved area before the LCID. 14 – Digital pictures taken during this inspection of items of interest and items in need of attention.

The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.

• INERT DEBRIS (Concrete) in need of grinding or moved to the LCID NOTIFIED AREA. See attached document, 130A-309.05 (C).
• Mixed waste that needs to be taken to the Permitted Landfill.

• Land Clearing Debris on the South Side that have not been covered in the required timeframe. Monthly at a
minimum. Some may have been recently pushed into the wooded / vegetative areas but some have vegetation growing on top.
