February 28, 2020. PURPOSE OF SITE VISIT: Comprehensive Inspection STATUS OF PAST NOTED VIOLATIONS: None. OBSERVED VIOLATIONS: None. The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. ADDITIONAL COMMENTS: 1. The facility is permitted as a Construction and Demolition (C&D) Landfill. Facility operations also include a Page 1 of 4 FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management NORTH CAROLINA Solid Waste Section treatment and processing area for concrete, asphalt and brick (CAB). 2. The facility is permitted to receive C&D waste, inert debris, land clearing waste and used asphalt that is generated in Forsyth County. 3. At the time of this inspection, the facility was closed, having ceased accepting waste as a result of staffing issues related to the COVID-19 pandemic. The facility closed on May 20, 2020, and the Solid Waste Section was apprised of the facility closure on May 22, 2020. Photos of the current disposal operating area were provided to the Section via email to demonstrate that adequate cover had been put into place as required. On June 11, 2020, the Section was notified via email that the facility would reopen on June 15, 2020 and that staff were working at the landfill to repair erosion damage on the side slope around the operating area that had resulted from heavy rain events over the past several weeks. This inspection was undertaken to ensure that the facility was prepared to reopen as scheduled. Records Review: 4. The life of site Permit to Operate and approved Operation Plan (revised February 2020) are maintained at the scale house and were available online for review prior to the inspection. 5. Tonnage records were provided by Adam Rickett via email and included data for FY 1992-93 through FY 2019-20 to date. A review of the information indicated that a total of 47,504.66 tons of waste were accepted at the facility from July 1, 2019 through May 31, 2020. Records also showed that this waste was brought to the facility in 21,161 loads (trips). These figures are consistent with recent activity at the facility. 6. Landfill gas monitoring is performed by facility staff on a quarterly basis, as required. Records of the monitoring events that occurred since the previous inspection on July 26, 2019 were also provided for review via email. These records provided field logs of sampling that took place on September 12, 2019, December 12, 2019, March 5, 2020 and June 2, 2020. Sampling logs noted that the scale house and all wells were sampled during each of these events. No methane exceedances were indicated in the sampling logs. 7. Groundwater monitoring takes place semi-annually, as required, and is performed by HDR Engineering. Reports covering the last two sampling events were available online for review. These reports indicated that the second sampling event for 2019 took place November 12-18, 2019. The report for the first sampling event in 2020 had not yet been provided by the consultant. 8. Waste screening records were not reviewed during this inspection. 9. Copies of current NC SWANA Landfill Operations Specialist training certifications for the following facility staff were provided by email: George Tilley — expires February 8, 2023; Clayton Hart — expires February 17, 2023; Barry Harris — expires March 1, 2023; Brian Parker — expires February 20, 2021; In addition, a current SWANA Manager of Landfill Operations certificate was on file for: Adam W. Rickett — expires August 6, 2020. (It should be noted that records indicate Mr. Rickett has filed for renewal along with proof of 34.5 CEUs but has not yet received his new certificate.) Field Inspection: 10. In addition to the required signage, a notice had been posted at the facility entrance that stated the facility was closed and that directed waste to the Hanes Mill Road MSW Landfill. Mr. Harris opened the gate but was not present during the actual inspection of the facility. 11. The site is protected from unauthorized access by a perimeter fence and secured by gates that are kept locked when the facility is closed. 12. The facility was observed to be clean and well maintained. Windblown litter was well managed. 13. Access roads are of all-weather construction and were found to be in good condition. 14. The concrete -asphalt -brick (CAB) collection area located to the west of the scale house had been roped off and a new collection area had been established on the top of the active landfill on the west side of the access Page 2 of 4 FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management NORTH CAROLINA Solid Waste Section roadway opposite the tipping area. Signs listing materials that are acceptable in the CAB area had been relocated from the old site to the new area. 15. Crushing operations appeared to have been taking place at the facility prior to the closure of the landfill. A stockpile of crushed material was situated on the north side of the old CAB area, with unprocessed debris staged on the south side. Some unacceptable materials, presumably generated during crushing operations, were observed mainly in the area between the processed and unprocessed debris. These unacceptable materials included rebar and metal pipe. In addition, a large concrete staircase coated with green paint and some concrete pieces covered with mastic and tile were found in the unprocessed waste stockpile. At the conclusion of the inspection, Mr. Harris stated that these materials had been uncovered during crushing operations, and that staff had already been tasked with taking them to the working face for proper disposal. Mr. Harris provided photos of the old CAB area following the inspection to show that the unacceptable materials had been removed and disposed of properly in the landfill. (See photos at the end of this report.) 16. An area adjacent to a closed section of the landfill has been designated as a temporary disaster debris storage site (DS34-006) for the county. The access for the site when it is active is located off Friedberg Church Road, however access from within the landfill facility is located across the roadway from the CAB area. The disaster debris site appeared to well -maintained with an established vegetative cover. 17. Edge of waste markers were clearly visible on all areas of the landfill and allowed the identification of the waste boundary along an unbroken line of sight around the landfill perimeter. 18. No inspection of the groundwater and landfill gas monitoring system was undertaken on this date. However, several monitoring wells were observed and found to be properly constructed and easily accessible. 19. The active portion of the landfill had received adequate cover at the time the facility was closed on May 20, 2020. Photos were provided by Gordon Dively to show that the active area had been cleared of windblown litter and covered completely. During this inspection, erosion rills created by heavy rain events in the interceding weeks were noted on the slopes surrounding the current operating area. Repairs had already been completed in many areas, and facility staff were observed completing these slope repairs. Mr. Dively provided photos following the inspection to show the completed repairs. (See photos at the end of this report.) 20. The tipping area had a compacted stone base and was adequately sized to enable vehicles and equipment to maneuver safely. 21. The perimeter ditch line that follows the toe of the active landfill appeared to be functional. Some sediment build-up was noted in several areas.
