Please note that Site A-1 is not approved as submitted. This is due to the area (see attached)immediately upgradient from the proposed fill area, which would impound surface runoff. In order for a permit to be issued for this area, the runoff fromthe area would have to be managed in a controlled way so that excessive erosion or impounded water would not occur. This permit may be subject to review at an administrative.hearing upon petition of anyone whose legal rights, privileges, and duties may have been affected by the issuance thereof. 2. This permit shall not be effective unless the certified copy is filed in the register of deeds' office, in the grantor index under the name of the· owner of the.land in the county or counties in which the land is located. 3. Jr. 1808 16th Street, NE Hickory, NC 28601 ' I September 23, 1982 Re: Huffman Demolition Landfil 1 Permit Application Dear Mr. Laffon: We are in receipt of your letter objecting to the demolition landfill permit application on file with this office. The application has been reviewed and a permit issued for area A-2 identified on the enclosed map. Area A-1 has been denied until the applicant can demonstrate how water collecting in the hatched area, on enclosed map, will be managed. It is felt that ponding may occur as a result of fill fog area A-1. As for the specific objections you have raised, ---CwiTf-try to address each of them.---------. -- I saw no evidence of excessive erosion or siltation occurring in the drainage- way below the site .. The photographs of runoff from behind your house is from an old fill area which is not under consideration for a permit. This.material has been identified as an iron bacteria, Gallionella, by the bacteriological section of the State Environ- mental Health Labw. This bacteria is naturally occurring, non-pathogenic, and of no public health concern. From discussions with engineers in the State Water Supply Section, this material is only objectionable from an aesthetic stand- point. The site has been visited by a representative of the Land Quality Section of the Department of Natural Resources and Community Development. We feel the best recommendation is the installation of brush barriers at the toe of the slope to reduce any off-site siltation. C. 28658 subject, Inventory & Evaluation -Huffman Construction Company Demolition Dump Site -Erosion Recommendations To= Bob Apple DNRCD, 810 Westminster Circle Lenoir, North Carolina 28645 Date: August 17, 1982 File Code: I met with Joe Huffman today persua.nt to our conversation on August 11, 1982. We drove out to the existing dump site on the Floyd property which Mr. Huffman is currently using. As we agreed last Wednesday, the water flowing down the slope behind the Laffon property is not originating from the dump site Mr. Huffman is using. Most of the watershed on the drain behind the Laffon property originates on and above the "old" existing dump site that is now not in use. The drain for this water- shed is the third draw right of the gravel and concrete road looking upstream. The second draw to the right, using the same references, is the one at the head of which Mr. Huffman is now using as his dump site. It contributes in no way to the water coming down beside the Laffon property. It is a separate watershed. The first draw, along the side of which runs the gravel and concrete road, and the second draw, to the right, have a. common drain. This is the 1811 culvert running under the concrete part of the road at its low point. (There is a shack beside this concrete road on the right going toward the lake. The culvert empties beside this shack.) After observing Mr. Huffman's present dump site, the only recommendations I provided were: 1. Sow in grass, and maintain this grass, on the flat area of his fill that will not be subjected to travel or damage by heavy equipment. This will reduce the speed of which runoff occurs and will filter the runoff. 2. Do not make the slope of the fill so steep that it is unstable or that it cannot be adequately sown to grass and maintained. 3. Maintain the dirt road to the dump to keep erosion to a minimum. 4. Do not allow the water leaving the dump site to enter the draw below any faster than it no:rma.lly would if the dump wasn•t there. Construction oate, Augu.st 17, 1982 Company Demolition Dump Site -Erosion Recommendations :Bob Apple File Code: Concerning the culvert draining both draws down at the concrete roa.d, I was unable to see how the present dump site would contribute enough water by itself to cause the flooding of' the concrete driveway. I observed the way the culvert was installed. Only a.bout 1.5 -2 feet of hea.d. over the upper invert can be achieved before water flows over the road. Given this size culvert, this is probably not enough head to charge the pipe and force it to carry the cubic feet per second (cfs) it needs to drain the water shed without topping. The gravel road coming down the first dra.w is contributing substantially to the rapid runoff and sediment found in the bottom of this draw. The road does not have the necessary runoff and erosion control measures it needs to prevent its deterioration. Due to the size of the watershed and the steep land involved, I doubt that a 1811 culvert is satisfactory to convey the run- off even under the best hydrologic conditions.
